ملاحظات زیست‌محیطی در قراردادهای نفتی

کشورهای جهان سوم، به ویژه ایران و عراق، با وجود داشتن منابع غنی نفتی در دنیا، توجه کمتری به آلودگی‏های ناشی از این منابع داشته‏اند. به نظر می‏رسد مشکلات پیش‌آمده در دنیا و تحریم‏ها علیه ایران باعث شده بود که تنها بر کشف، حفاری و استخراج تمرکز شود. البته به تازگی ایران و دیگر کشورهای جهان سوم، نیز به این مهم توجه و تاکید دارند؛ زیرا با مشکل آلودگی، پیامدها و هزینۀ سنگین آن برای کشور و شهروندان روبه‏رو شده‏اند؛ اما معضلات آلودگی ناشی از استخراج معادن، تنها به انسان‏ها بازنمی‏گردد. آلودگی نفتی، زندگی آبزیان و چرخۀ اکوسیستم را با خطر جدی روبه‏رو کرده است. این پژوهش، با بیان ملاحظات قانونی و قراردادی حفاظت از محیط ‌زیست در قراردادهای مختلف نفتی ایران، به بررسی قواعد و الزامات محیط ‌زیستی در برخی کشورهای نفت‏خیز جهان همچون نروژ، تایلند، اندونزی و کردستان عراق پرداخته و با واکاوی قراردادهای منعقده و قوانین و مقررات الزام‌آور زیست‏محیطی، مطالعه‏ای تطبیقی دربارۀ رعایت یا عدم رعایت الزامات قانونی و قراردادی در زمینۀ مقابله با آلودگی در صنعت نفت وگاز آن کشورها و ایران داشته و به این نتیجه دست ‌یافته است که در طول زمان، مقررات و قواعد محیط ‌زیستی بهتر و بیشتری از جانب دولت‏های میزبان برای شرکت‏های فعال در زمینۀ اکتشاف، استخراج و حمل مواد هیدروکربنی وضع و اجرا شده است.

ENVIRONMENTAL CONSIDERATIONS IN THE PETROLEUM CONTRACTS

Third world countries leading by Iran and Iraq, have paid less attention to pollution due to their rich oil resources in the world. It seems that the problems in the world and the sanctions against Iran had left the focus only on discovery, drilling and extraction. But recently, Iran and other thirdworld countries have also paid attention to this important issue, because they have faced the problem of pollution, its consequences and heavy costs for the country and its citizens. However, the problems of pollution from mining are not limited to humans. Oil pollution poses a serious threat to aquatic life and the ecosystem cycle. This study, by expressing the legal and contractual considerations of environmental protection in various Iranian oil contracts, examines the environmental rules and requirements in some oilrich countries such as Norway, Thailand, Indonesia and Kurdistan, and analyzes the concluded contracts and binding laws and regulations. Environmental studies have conducted comparative studies on the observance or nonobservance of legal and contractual requirements in the field of pollution control in the oil and gas industry of those countries and Iran. As a result, it has become clear that over time, environmental regulations have been established and implemented by host governments for companies active in the exploration, extraction and transportation of hydrocarbons.
