   وضعیت حقوقی الزامات زیست‌محیطی کنوانسیون مارپل برای دولت‌های عضو کنوانسیون 1982 حقوق دریاها

چکیده    یکی از مواردی که کنوانسیون 1982 حقوق دریاها بدان پرداخته است، حفاظت از محیط زیست دریاست. چالش اساسی در این زمینه، این است که کنوانسیون در بیشتر موارد، تنها به بیان اصول و الزامات کلی پرداخته و قواعد جزئی‌تر و معیارهای خاص زیست‌محیطی را ذکر نکرده است. این مسئله می‌تواند مشکلات بسیاری برای دولت‌های عضو در مقام اجرای تعهدات زیست‌محیطی خویش ایجاد کند. دلایل این امر، از جمله احتراز از مشکلات عملی و دشواری‌های ناشی از اصلاح و به‌روزرسانی این کنوانسیون جهت هماهنگی با معیارهای جدیدتر است. راهکاری که در کنوانسیون 1982 اندیشیده شده است، احاله به قواعد و معیارهای موجود در اسناد دیگر، همچون «کنوانسیون بین‌المللی جلوگیری از آلودگی ناشی از کشتی‌ها (مارپل)» است که به‌مراتب بازنگری و به‌روزرسانی آن‌ها ساده‌تر انجام می‌شود. مشکلی که در این زمینه وجود دارد، در خصوص وضعیت حقوقی قواعد و معیارهای موجود در کنوانسیون اخیر برای دولت‌های عضو کنوانسیون 1982 است؛ زیرا این کنوانسیون هیچ‌گاه به‌صراحت به این سند اشاره نکرده است. با وجود این، به نظر می‌رسد این قواعد و معیارها برای دولت‌های عضو کنوانسیون 1982، همچون مقررات کنوانسیون یادشده، جنبۀ الزام‌آور داشته باشد.

   Legal Status of the Environmental Requirements of the MARPOL Convention for the States Parties to UNCLOS

Abstract    One of the issues addressed by the UNCLOS is the protection of the marine environment. The major challenge in this respect is that the Convention has in most cases only referred to general principles and requirements and has not specified more detailed rules and specific environmental standards. This can create many practical problems for States Parties in fulfilling their environmental obligations. The reasons for this include avoiding the practical difficulties and difficulties caused by the amendment and updating of this Convention in order to comply with the newer standards. The approach taken in UNCLOS is to refer to the rules and standards contained in other instruments, such as the “International Convention for the Prevention of Pollution from Ships (MARPOL)”, which is much simpler to amend and update. The challenge is the legal status of the rules and standards in the recent Convention for the States Parties to UNCLOS, since; the convention has never explicitly referred to this document. However, these rules and standards seem to be binding for States Parties to UNCLOS, such as the provisions of the MARPOL.
