الزامات شکلی فرایند برگزاری مناقصات در نظام حقوقی ایران و موافقت‌نامۀ تدارکات دولتی سازمان تجارت جهانی؛ موردپژوهی قراردادهای نفتی

به خریدهایی که دستگاه‌های دولتی برای تامین نیازهای خود و با اهداف غیرتجاری انجام می‌دهند، تدارکات دولتی گفته می‌شود. تدارکات دولتی، فرایند رقابتی است که از مراحل مختلفی تشکیل شده است. این مقاله درپی آن است که به صورت تطبیقی مراحل بالا را در دو نظام حقوقی ایران و سازمان تجارت جهانی بررسی کند و به این نتیجه می‌رسد که در خصوص فرایند برگزاری مناقصه، تفاوت‌های اساسی و غیراساسی در نظام حقوقی ایران با سازمان تجارت جهانی وجود دارد که در راستای الحاق ایران به سازمان تجارت جهانی باید تفاوت‌های اساسی تا حدودی برطرف شود. افزون بر این، نگاهی گذرا به قوانین و مقررات مربوط به مناقصات در صنعت نفت خواهیم انداخت. در مقالۀ پیش رو، از روش توصیفی تحلیلی و تطبیقی استفاده می‌شود.

Comparative Comparison of the Formal Requirements of the Bidding Process in the Iranian Legal System and the WTO Government Procurement Agreement Government procurement refers to purchases made by government agencies to meet their needs for noncommercial purposes. Government procurement is a competitive process that consists of several stages. This paper comparatively examines the above steps between the two legal systems of Iran and the World Trade Organization and concludes that there are fundamental and nonessential differences in the bidding process in Iran’s legal system with the World Trade Organization. In order to join Iran in the WTO, some major differences must be resolved. In the meantime, we will take a brief look at the rules and regulations related to tenders in the oil industry. This paper uses a descriptiveanalytical and comparative method.
