لولهگذاری زیردریایی در تقابل با اعمال حقوق حاکمۀ دولت ساحلی در منطقۀ انحصاری اقتصادی و فلات قاره

چکیده
|
عبور لولههای زیردریایی انتقال نفت و گاز از منطقۀ انحصاری اقتصادی یا فلاتقارۀ دولت ساحلی با تقابل در منافع مختلف همراه است. برقراری تعادل در این زمینه در بستر آموزههای حقوق بینالملل دریاها ضروری است. از این رو، بررسی ابعاد آن با الگوی توصیفی و تحلیلی، موضوع این نوشتار است. پرسش اصلی پژوهش این است که بایستههای حقوق و تعهدات دولت ساحلی در تقابل با حقوق و تعهدات دولت متقاضی لولهگذاری زیردریایی انتقال نفت و گاز در مناطق انحصاری اقتصادی و فلاتقارۀ دولت ساحلی چیست؟ یافتههای پژوهش نشان میدهد که دولتهای ساحلی، خواهان ایجاد محدودیت بیشتر پیش روی دولتهای متقاضی لولهگذاری زیردریایی در منطقۀ انحصاری اقتصادی و فلاتقاره هستند؛ در حالیکه دولتهای متقاضی نیز به موجب اصل آزادی دریاها دارای آزادی عمل در لولهگذاری زیردریایی هستند. با وجود این، تعیین مسیر برای خطوط لولۀ زیردریایی، موضوع رضایت دولت ساحلی است که دولت متقاضی لولهگذاری زیردریایی ناگزیر از جلب آن است.

Submarine Pipelines in Contrary to the Sovereign Rights of the Coastal State’s Exclusive Economic Zone and Continental Shelf

|
Abstract: Transit of oil and gas submarine pipelines through Coastal State’s exclusive economic zone and Continental Shelf has conflicting interests which necessitates balancing this in the context of International Law of the Seas, which is the subject of this paper by descriptive and analytical model. The main question of the research is what are the rights and obligations of the coastal state as opposed to the rights and obligations of the oil and gas submarine pipeline applicant in the Coastal State’s exclusive economic zone and Continental Shelf? The research findings show that coastal states want to further restrict the submarine pipeline applicant in the Coastal State’s exclusive economic zone and Continental Shelf, while the latter also have the freedom to lay submarine pipeline. However, delineation of the course for laying of pipelines is subject to the consent of the coastal state which the submarine pipeline applicant requires of catch it.
