صلاحیت ایکسید در پرتو رای 2018 این دیوان در دعوای شرکت ماسدار علیه دولت اسپانیا در مورد سرمایه‌گذاری در حوزۀ انرژی‌های تجدیدپذیر

مرکز بین‌المللی حل‌وفصل اختلافات سرمایه‌گذاری (ایکسید) در 16 می 2018، رای نهایی خود در خصوص دعوای شرکت هلندی ماسدار علیه دولت اسپانیا را صادر کرد. دیوان ضمن تایید نقض منشور انرژی از سوی دولت اسپانیا، این دولت را به جبران خسارت وارده به خواهان محکوم کرد. احراز صلاحیت دیوان و پذیرش دعوا، در حالی است که صلاحیت دیوان از جنبه‌های مختلف شخصی، موضوعی و اولویت اتحادیۀ اروپا مورد اعتراض دولت اسپانیا قرار گرفته بود. در این باره، مبنای اصلی استنادات خواهان و خوانده و تجزیه و تحلیل دیوان مبتنی بر منشور انرژی و کنوانسیون ایکسید است؛ زیرا هر دو سند برای دولت هلند به عنوان دولت متبوع خواهان و دولت اسپانیا به عنوان خوانده، لازم‌الاجراست. با توجه به اینکه، یکی از دستاوردهای مهم این رای، بررسی ابعاد مختلف صلاحیت ایکسید در زمینۀ اختلافات ناشی از سرمایه‌گذاری در حوزۀ انرژی‌های تجدیدپذیر است، نوشتار پیش رو، درپی واکاوی این مباحث است.

The Jurisdiction of ICSID under the Arbitration Award between MASDAR SOLAR &WIND COOPERATIEF U.A. and KINGDOM of SPAIN Regarding the Renewable Energy Investment

On 16 May 2018, ICSID issued its Award between the Masdar as a Dutch company against the Spanish. The court confirmed the violation of the Energy Charter by the Spain and sentenced it to compensate for damages to the plaintiff. Despite the challenges to the Court’s jurisdiction raised by the Spanish in the various aspects such as personal, thematic and the priority of EU, The Court accepted its jurisdiction to hear the case. In this respect, the main basis of the plaintiff’s pleadings and the court’s analysis are based on the Energy Charter and the ICSID Convention; because both documents are mandatory for both Parties. As regard that one of the major achievements of this award is to examine the various aspects of the jurisdiction of ICSID in relation to the disputes arising from the renewable energy investment, the present Article seeks to analyze these issues.
