تحلیل روش های جایگزین حل و فصل اختلافات (adr) در قراردادهای جدید بالا دستی نفتی ایران ipc

روش های «adr» برای چند دهه به عنوان روشی مناسب جهت حل وفصل اختلافات در قراردادهای بین المللی بالادستی صنعت نفت و گاز معرفی شده است.اکنون پرسش این است که آیا «adr» در ipcارجاع به همۀ ابزارهای آن است یا نوع خاصی از آن را مدنظر دارد و در حقیقت تبادر در «adr» چیست؟این مقاله برآن است تا با بررسی قراردادهای بین المللی بالادستی صنعت نفت و گاز، به این مهم پاسخ دهد. نتایج این مقاله، گواه آن است که ترکیب دو فرایند کارشناسی و داوری، می تواند روابط قراردادی بلندمدت طرفین را حفظ کرده و از لحاظ زمانی و مالی کارایی لازم را داشته باشد. پژوهش پیش رو، ثابت می کند که کارشناسی داوری، روش برتر حل وفصل اختلافات در قراردادهای جدید بالادستی صنعت نفت و گاز، موسوم به ipc  است.

Analysis of alternative dispute resolution methods (ADR) On Iran’s new upstream oil contracts IPC

ADRs have been introduced for decades as an appropriate way to resolve disputes in upstream international contracts in the oil and gas industry; an example of this is the adoption of the International Commercial Compromise Law. The question to be addressed here is whether or not the ADR in the IPC is a reference to all of its instruments or to a particular type of instrument and what is the ADR in fact. This article aims to respond to this by reviewing upstream international contracts in the oil and gas industry. The results of this paper confirm that the combination of two expert and arbitration processes can maintain longterm contractual relationships of the parties and be efficient in terms of time and finances. This research proves that peerreview is the best way to resolve disputes in new upstream contracts in the oil and gas industry called IPC.
