رابطۀ امنیت آب و بلایای طبیعی در حقوق بین‌الملل

بلایای طبیعی و انسانی بخش گریزناپذیری از حیات است که ابعاد گوناگون زندگی انسان‌ها را تهدید می‌کند. امروزه با افزایش میزان بحران آب در جهان، توجه جامعۀ بین‌المللی به موضوع امنیت آب جلب شده و نقش مدیریت بلایا، به معنای آمادگی، واکنش و بازسازی به منظور کاهش آثار بلایا، در حصول امنیت آب مورد توجه قرار گرفته است. این پژوهش، به بررسی رابطۀ متقابل امنیت آب و مدیریت بلایا و کنکاش در قواعد ذی‌ربطِ حقوق بین‌الملل موضوعه پرداخته است. دستاورد بررسی‌های توصیفی و تحلیلی نگارندگان، حاکی از آن است که گرچه تاکنون سند حقوقی الزام‌آور یکپارچه‌ای در موضوع مدیریت بلایا در حقوق بین‌الملل شکل نگرفته است، اما برخی از قواعد شاخه‌های مختلف این حقوق، از جمله حقوق بین‌الملل بشر، حقوق بین‌الملل محیط زیست، حقوق بین‌الملل منابع آبی فرامرزی، تعهداتی را در مراحل مختلف مربوط به بلایا، یعنی پیش از وقوع آن‌ها، در هنگام وقوع و پس از آن، بر عهدۀ بازیگران عرصۀ بین‌المللی، به ویژه دولت‌ها، قرار می‌دهد که در تامین امنیت آب نقش بسزایی دارد؛ هرچند تضمین پاسداشت این تعهدات، خود چالشی مهم است که نیازمند چاره‌اندیشی جهانی است.

THE RELATION BETWEEN WATER SECURITY AND NATURAL DISASTERS IN INTERNATIONAL LAW

Natural and manmade disasters are an inevitable part of life which threaten various dimensions of human life. Nowadays, increasing water crisis, in all around the world, attracts the attention of international community to the issue of water security and the role of disaster management in the sense of preparedness, response and reconstruction in order to reduce the impact of disasters in accessing water security has been taken into consideration. This investigation has studied interaction of water security and disaster management and explored the applicable rules of International law in this topic. The descriptive and analytical studies of the authors shows that, there is no binding coherent legal document on disaster management in international law. However, some provisions of various areas of it including international human rights, international environmental law, international law of transboundary water resources and the like impose obligations on  international actors, particularly States, in the various stages of disasters including, before, during and after them. This plays a significant role in providing water security. Even though, ensuring compliance with these obligations is an important challenge that requires an effort at the global level.
