خرق حجاب شرکتی در قوانین و رویۀ اتحادیۀ اروپایی در خصوص تحریم شرکت‌های زیرمجموعۀ شرکت ملی نفت ایران

تحریم‌های هسته‌ای اتحادیۀ اروپایی، مجموعه‌ای از اقدامات محدودکننده بود که آثار سوء آن، بیش از هر بخش دیگری از کشور، در صنعت نفت ایران که صنعت اصلی کسب درآمد کشور است، نمایان شد. این اقدامات محدودکننده تا بدان‌جا پیش رفت که شرکت‌های مشمول تحریم‌ها، نه تنها از انجام هرگونه معامله و سودآوری در حوزۀ صلاحیت اتحادیه منع شدند، بلکه تمامی دارایی‌ها و منابع آن‌ها نیز توقیف شد. مقالۀ پیش رو، می‌کوشد با بررسی قوانین و رویۀ قضایی شکل‌گرفته از دعاوی تحریمی، معیارهای حقوقی تحت شمول تحریم قرار گرفتن را استخراج کرده و با وضعیت شرکت‌های مورد نظر تطبیق دهد تا تصویر روشنی از چرایی تحریم شدن شرکت‌های نفتی ایرانی در اتحادیۀ اروپا ترسیم شود.

PIERCING THE CORPORATE VEIL IN EU LAWS AND LEGAL PRECEDENT IN RELATION TO SANCTIONING THE SUBSIDIARIES OF THE NATIONAL IRANIAN COMPANY

Nuclearrelated economic sanctions of EU against Iran were a set of restrictive measures, the negative impact of which was felt more in Iran’s oil and gas sector, it being the main incomegenerating sector of Iran’s economy. These sanctions were applied to the extent that the designated entities were not only prohibited from doing any transaction with elements within the EU jurisdictions, but also all their assets and economic resources were frozen. This article reviews the relevant laws and legal precedents which have been formed over the sanction’s disputes and delisting cases by studying the legal elements of designating an entity and the legal situation of Iranian oil companies under EU Sanctions. The paper at hand endeavors to present a better picture of the reason and logic behind listing of Iranian oil companies in the EU list of designated entities.
