حق پدیدآور مقاله علمی – پژوهشی بر آگاهی از سرنوشت اثر (بررسی مرحله داوری، مطالعه تطبیقی)

پس از آن‌که نویسنده دست‌نوشته‌اش را در سامانه نشریات علمی _ پژوهشی به ثبت رساند، آیا چنین حقی دارد که از سرنوشت دست‌نوشته‌اش در فرایند پذیرش تا چاپ آن آگاهی یابد یا نه؟ و اگر چنین است، این حق در حقوق ایران بر کدامیک از مبانی حقوقی و مستندات قانونی استوار است. نگاهی به راهنمای نشریات علمی _ پژوهشی در ایران نشان می‌دهد که تاکنون به این موضوع و چنین حقی توجه نشده است، در حالی که در علمی _ پژوهشی غیر ایرانی، زمان‌بندی ارائه شده در راهنمای پذیرش مقاله‌ها نشان می‌دهد که این گروه از نشریات تا حدی چنین حقی را به رسمیت شناخته‌اند. در این مقاله ضمن بیان مبانی حقوقی وجود این حق در حقوق ایران، از طریق مقایسه و مطالعه تطبیقی، وضعیت موجود در نشریات مهم علمی _ پژوهشی در ایران و نیز چند کشور خارجی بررسی شده و با ارائه نمودارها و سنجش‌های لازم، علاوه بر آن‌که وجود این حق در ایران نیز به اثبات رسیده، پیشنهاد شده که در نشریات علمی _ پژوهشی ایران نیز در راهنمای پذیرش مقاله‌ها، به اعلام زمان‌بندی مربوط به هریک از مراحل موجود در فرایند پذیرش تا چاپ مقالات، به‌ویژه مرحله داوری توجه شود.

The right of the author of the scientific article research on the awareness of the fate of the work(Reviewing the stage of arbitration, comparative study)

Abstract: After the author writes the article in the system of scientificresearch publications, is it right to know the fate of his article in the process of admission to publication? And if so, this right in Iran's law is based on which legal basis and legal documentation. A look at the guidebook of scientific journals in Iran shows that so far this and such a right have not been addressed, while in nonIranian scholarly research, the timing provided in the admission guide for papers shows that this group of publications has such a right have been recognized. In this article, while expressing the legal foundations of the existence of this right in Iranian law, through comparison and comparative study, the status of important scientificresearch publications in Iran and several foreign countries has been examined and with the will of the necessary diagrams and measurements, in addition to the existence This right has also been proven in Iran. It has also been suggested that the Iranian Journal of Science and Research publishes the timetable for admission to publishing articles, especially the arbitration process.
