ایجاد طفل ناجی‌ در بوته تحلیل فقهی

سابقه و هدف: پیشرفت‌های شگرف دانش پزشکی، پزشکان اندیشمند را برآن داشته است تا با بهره‌گیری از تحقیقات جدید درصدد درمان و ارتقای سلامت انسان برآیند. ازجمله مسائل نوپیدای علم پزشکی، استفاده از فرایند «برادر و خواهر ناجی» برای درمان برادر یا خواهر بیمار است. خواهر و برادر ناجی (savior siblings) به خلق یک انسان همسان ژنتیکی اشاره دارد تا مواد بیولوژیکی مانند خون، مغز استخوان یا حتّی اعضای بدن را برای یک خواهر یا برادر بیمار فراهم کند.مواد و روش ها: پژوهش حاضر که با روش توصیفی‌تحلیلی و با بهره‌گیری از منابع کتابخانه‌ای سامان یافته است، سعی دارد مشروعیت یا ممنوعیت ایجاد فرزندی به‌عنوان برادر یا خواهر اهداکننده (ناجی) را در پرتوِ تحلیل ادلّه فقهی موردالتفات قرار دهد. اهمیت بحث ازآن‌رو رخ می‌نماید که بین حلیت یا حرمت ایجاد خواهر و برادر ناجی، نوعی تعارض وجود دارد.یافته ها: ما درصدد پاسخ به این سوال هستیم که آیا این شکل از انتخاب با توجه به ادلّه فقهی مشروعیت دارد یا اینکه جایز نیست و باید ممنوع شود. چه ازسویی منع این عمل ممکن است موجب مرگ برخی از کودکان نیازمند اهدای برادر و خواهر ناجی شود و ازسوی‌دیگر چه‌بسا برادر و خواهر ناجی به‌سبب اهدا با خطرات و عواقبی دست‌وپنجه نرم کنند. استنتاج: فرجام تحقیق آن است که ادلّه فقهی نمایانگر مشروعیت این اقدام مشروط به رعایت قواعد و شرایطی مانند انتفاع هر دو طرف است.

background and purpose: recent advancements in medical science have prompted thoughtful physicians to utilize new research in efforts to treat and enhance human health. among the emerging issues in medical science is the use of the savior sibling process to treat a sick brother or sister. savior siblings refer to the creation of a genetically identical human being to provide biological materials, such as blood, bone marrow, or even organs, for a sick siblingmaterials and methods: this study, organized through a descriptive-analytical method and utilizing library resources, aims to explore the legitimacy or prohibition of creating a child as a donor sibling (savior) through an analysis of relevant jurisprudential arguments. the importance of this discussion arises from the existing conflict between the permissibility and prohibition of creating savior siblings. results: we seek to answer whether this form of selection is legitimate according to jurisprudential arguments or if it should be prohibited. on the one hand, prohibiting this action may lead to the death of some children in need of a savior sibling donation, while on the other hand, savior siblings may face risks and consequences due to their role as donors.conclusion: the conclusion of this research is that jurisprudential evidence indicates the legitimacy of this action, provided that certain rules and conditions, such as mutual benefit for both parties, are observed.
