تحلیل تاثیر روایات اسرائیلی بر آراء فقهی مفسران تا پایان قرن 5 (با تاکید بر خلقت حواء در سفر پیدایش)

نفوذ روایات اسرائیلی (به معنای اخص) که اصلی‎ترین منبع آن‌ها متون دینی یهود و نقل‎های اهلِ‎کتابِ نومسلمان بود، به منابع روایی و تفسیری مسلمانان، امری مسلّم است. این نوشتار با روش توصیفیتحلیلی و انتقادی به بررسی تاثیر این روایات بر آراء فقهی مفسران پرداخته است. اعتماد کورکورانه برخی از مسلمانان به این روایات، نقل مکرّر و کتابت آن‌ها در کتب روایی باعث گردید کثرت نقل بر عقل سیطره یافته، روایات مخالف با آموزه‎های قرآن کریم، مقبول اکثر مفسران و عالمان افتد. پیامد این پدیده، صدور احکامی فقهی بر پایه‎ی آموزه‎های اسرائیلی بود. آنچه از محتویات سفر پیدایش به روایات اسلامی نفوذ یافت و بر آراء مفسران در حوزه فقه اثر گذاشت، در عرصه احکام زنان کاملاً مشهود است. باور اسفه السفهاء بودن زنان و وجوب نصب قیم برای آن‌ها در امور مالیشان، قصاص نشدن مرد برای ضرب و جرح همسرش و ... احکامی از این دست هستند.

Analysis of the Impact of Israeli Narratives on the Jurisprudential Opinions of Commentators by the End of the 5th Century

the influence of the Israeli narratives (in a special meaning) that the main source of which were the Jewish religious text and the narratives from the new Muslim of AhlAlketab, is certain. This research is a descriptiveanalytical and critical method to study the effect of these narrations on the jurisprudential opinions of the commentators. The blind faith of some Muslims in these narratives, their frequent quotes, and their writing in narrative books defeated wisdom. The most commentators have accepted the narratives against the teachings of the Quran. The consequence of this phenomenon is the issuance of jurisprudence rulings based on these narratives. What influenced the Islamic narratives from the contents of the Genesis and influenced the opinions of commentators in the field of jurisprudence is evident in the field of women’s jurisprudence. Believing to: the women are silly, appointment of guardian for their finance, not punishing men for beating and injuring his wife and … are examples of that.
