ارکان جهت ساز نظام قانونگذاری در گفتمان ولایت فقیه

قانونگذاری از مهم‌ترین مسائل و موضوعات راهبردی در مدیریت کلان همه نظام‌های سیاسی از جمله نظام جمهوری اسلامی ایران است. بدیهی است قانونگذاری در هر کشوری بر پایه مبانی و ارزش​های اساسی و ارکان جهت سازی که عمدتاً ریشه در اندیشه رهبران و قانون اساسی کشور دارد، انجام می‌شود. براین اساس هدف این تحقیق تبیین ارکان جهت ساز (اهداف، دکترین​ها و سیاست‌های کلی) نظام قانونگذاری کشورمان بر پایه گفتمان ولایت فقیه (امام خمینی(ره) و مقام معظم رهبری) است. روش تحقیق مورد استفاده توصیفی تحلیلی و تجزیه و تحلیل اطلاعات با روش تحلیل محتوای کیفی با جمع آوری اطلاعات به صورت کتابخانه ای از جامعه آماری شامل کلیه اسناد در دسترس حاوی رهنمودها و فرمایشات امام خمینی(ره) و مقام معظم رهبری به انجام شده است.نتایج تحقیق مهم‌ترین ارکان جهت ساز مورد نظر را به شرح زیر نشان می‌دهد:اهداف: بسط شریعت اسلام، برقراری و گسترش عدالت در جامعه، حفظ و تداوم ارزش‌های انقلاب، انسان سازی و حفظ و توسعه هنجارها و سرمایه‌های اجتماعی و فضایل اخلاقی، تامین حقوق اساسی و مطالبات مشروع مردم، ارائه الگوی نوین قانونگذاری مبتنی بر اسلام ناب محمدی (ص) به جهان.دکترین ها: حاکمیت قانون خدا، قانونگذاری بر مبنای شریعت اسلام ناب محمدی (ص)، پایبندی به اصل ولایت فقیه، مردمسالاری دینی، عدالت همه جانبه، کرامت و کمال انسان، پایبندی به قانون اساسی، اهمیت دادن به فضایل اخلاقی، بها دادن به دانش بشری و نظرات کارشناسی.سیاست ها: توجه ویژه به موازین اسلام ناب محمدی (ص)، تکیه بر اندیشه ولایت فقیه و حمایت از آن در وضع قوانین، انطباق قوانین عادی با قانون اساسی و پیاده سازی بهینه آن، اولویت دادن به منافع انقلاب و نظام و مردم، رعایت ویژگی‌های قانون خوب، تکیه بر وحدت کلمه و انسجام ملی و استمرار انقلاب ، قانونگذاری با رویکرد خودکنترلی و بها دادن به فضایل انسانی، اهمیت دادن به نظارت مستمر و کارامد و اثربخش بر اجرای قوانین.

The research method used was descriptiveanalytical and information analysis with qualitative content analysis method by collecting information in a library of statistical society including all available documents containing Imam Khomeini’s and Supreme Leader’s guidance and trials. .The results of the research show the most important directional components of the research as follows: Objectives: The expansion of the Islamic law, the establishment and expansion of justice in society, the preservation and continuation of the values ​​of the revolution, humanization and the preservation and development of social norms and norms and moral virtues, the provision of basic rights and legitimate demands of the people, the presentation of a new model of Islambased legislation Peaceful Mohammad (PBUH) to the world. Doctrines: The rule of law of God, the rule of law based on the Islamic law of pure Mohammadi (PBUH), adherence to the principle of Velayate faqih, religious democracy, universal justice, dignity and perfection of man, adherence to the constitution, the importance of moral virtues, Human knowledge and expert opinions.Policies: Paying special attention to the principles of pure Mohammadi’s Islam (PBUH), relying on the idea of ​​the Velayate faqih and supporting it in the formulation of laws, the conformity of ordinary laws with the constitution and its optimal implementation, prioritizing the interests of the revolution and the system and people, observance The features of good law, reliance on word unity and national cohesion and the continuation of the revolution, legislation with a selfcontrol approach and value to human virtues, the importance of continuous and effective monitoring of the implementation of the law.
