چکیده
|
یکی از مشهورترین قواعد فقه تربیتی که همواره مورد توجّه بسیاری از علماء بوده، قاعده ی « نفی عسر و حرج» است. مفاد اولیه ی این قاعده آن است که امتثال تکالیف تا زمانی برای مکلّفین واجب است که باعث ایجاد مشقّت برای آنها نگردد؛ در غیراین صورت تکلیفی ساده تر جایگزین شده و در پاره ای از مواقع حتّی اصل تکلیف نیز از عهده ی مکلّف برداشته می شود. عسر و حرج همواره یکی از موانع جدّی بر سر راه متربّیان در معنای عامِ آن بوده است. بنابراین ردّپای این قاعده را در امور تربیتی نیز می توان به وضوح مشاهده نمود. از جمله ی اموری که امروزه شاید بیش از هرچیز دیگری بعد از تکالیف عبادی از اهمیّت برخوردار است، مساله ی تربیت است. نهاد « نفی عُسر و حَرَج» یکی از مهمترین مبانی در راستای رعایت شرایط متربّی جهت انجام تکالیف وی است که بدون شک بررسی آن اهمیّت و ضرورت پرداخت به آن را در پیش چشمان اهل علم نمایان می کند.

Abstract
|
abstract:one of the most famous rules of educational jurisprudence, which has always been the focus of many scholars, is the rule of “difficulty conditions and situation&. the basic provision of this rule is about the compliance of the duties is obligatory for the obligee as long as it does not cause hardship for them; otherwise, a simpler task is replaced and in some cases even the original task is removed from the responsibility of the obligee. “difficulty conditions and situations” have always been one of the serious obstacles on the path of educators in a general sense. therefore, the traces of this rule can be clearly seen in educational affairs as well. among the issues that are perhaps more important today than anything else after religious duties, is the education issue. the institution of “difficulty conditions and situations& is one of the most important foundations in order to meet the conditions of the teacher to do his homework, which undoubtedly shows the importance and necessity of paying it in front of the eyes of the people of knowledge. keywords: “difficulty conditions and situations&,, educational principles, educational methods, education, teacher
