ادله فقهی حفظ مکان‌خاطره ها در شهر

مباحث فقه شهر و شهرنشینی از مباحث جدید و چالشی در ساحت فقه به‌حساب می‌آید. شهرها و جوامع از یک‌سو، و سطح کمی و کیفی زندگی شهرنشینان از سوی دیگر، رشد روزافزون داشته‌اند. این پیشرفت‌ها و گسترش‌ها و مواجهه با مباحث جدیدی که با زندگی شهرنشینی آمیخته شده‌است، ساحت فقه را بر این می‌دارد تا به فراخور مسائل و نیازهای جدید شهرنشینان، درصددِ پاسخگویی به سوالات و مباحث شهرنشینی در ساحت فقه و شریعت باشد. ازجمله مباحث شهری، جایگاه مکان‌خاطره‌ها در جامعۀ شهری از نگاه هویتی و اقتصادی و نقش موثر آن‌ها در این زمینه است. از سوی دیگر، حفظ و مراقبت و نگهداری از این مکان‌ها مسلتزم وضع قوانینی است که گاهی با ساحت فقهی و فردی شهروندان در تعارض قرار می‌گیرد. همچنین هزینه‌کرد از بیت‌المال برای حفظ و نگهداری این مکان‌ها که در برخی از اوقات متعلق به دوره‌های تاریخی و تمدنی غیراسلامی می‌شود، خودْ سوال‌برانگیز است که آیا این هزینه‌کرد امری مشروع است یا خیر؟ نگاه فقهی به این مساله در جامعۀ شهری اسلامی بسیار حائز اهمیت است و تحلیل درست مبانی فقهی می‌تواند راهگشا و پاسخگوی بسیاری از چالش‌ها، تعارضات و سوالات در این زمینه باشد.این نوشتار با نگاه فقهی ازمنظرِ ادلۀ شرعی، درصددِ اثبات لزوم حفظ و جلوگیری از ازبین رفتن مکان‌خاطره‌ها و نیز لزوم وضع قوانین اجرایی درجهتِ جلوگیری از تخریب این مکان‌ها توسط دیگران است.

Maintaining the Place of Memories in the City from the Perspective of Jurisprudence

The issues of urban and urbanization jurisprudence are new and challenging in the field of jurisprudence. The rapid development of cities and urban communities, the growth of the quantitative and qualitative level of urban life, and consequently facing new topics that are intertwined with urban life advocates jurisprudence in order to respond to the questions and issues of urbanization in accordance with the new issues and needs of urban dwellers in the construction of jurisprudence and sharīʻah. The place of memories in urban society in terms of identity and economy and their effective role is one of the urban issues that can be addressed. On the other hand, taking care of these places requires the enactment of laws that sometimes conflict with the individual jurisprudence of the citizens. Also, spending money from the public treasury to maintain these places, which are sometimes related to nonIslamic historical and civilizational periods, is itself questionable regarding the issue of whether it is legitimate to spend public funds to maintain these places or not. The jurisprudential view of this issue is very important in the Islamic urban society and the correct analysis of the jurisprudential principles can be the solution and response to many challenges, conflicts and questions in this field. This study uses a jurisprudential analysis from the perspective of evidence to prove the need to maintain the place of memories in urban communities.
