نقد و بررسی آرا و دیدگاه‌ها درباره تحقیر اهل‌ذمه در جزیه

یکی از انتقاداتی که کم‌ و بیش از سوی پژوهشگران غیرمسلمان، به‌ویژه غربیان بر فقه اسلامی در زمینۀ تعاملات آن با اقلیّت‌های دینی صورت گرفته، این است که فقه نگاهی تحقیرآمیز نسبت به آنان داشته و اقلیت‌های دینی را فاقد حرمت و کرامت انسانی دانسه و ازاین‌رو کارنامۀ فقه، در حوزۀ ذمیان تحقیرگراست. آنان در تایید مدعای خود به موضوع جزیه اشاره کرده و برابر تحلیل و ارزیابی‌شان از آرای برخی فقها، مدعی‌اند هم اصل تشریع و هم شیوۀ پرداخت فقه در مسئلۀ جزیه به‌منظور تحقیر ذمیان بوده ‌است. برخی گفته‌اند جزیه، همان باجی است که فاتحان از ملت‌های شکست‌خورده، آن‌هم به‌عنوان زورگیری و تخریب شخصیت آنان می‌گرفتند؛ که بازهم ماهیتی تحقیرآمیز دارد. شماری هم تحقیر ذمیان را به‌منظور جذب آنان به اسلام دانسته‌اند که این امر نیز خرده‌گیری‌های دیگری را به‌دنبال داشته است. این مقاله می‌کوشد ضمن پاسخ به این شبهات، تصویری عقلانی و منطقی از جزیه نشان دهد و این حقیقت را تبیین کند که پرداخت جزیه تنها در قبال خدمات و حمایت‌های نظام اسلامی از ذمیان صورت می‌گیرد، بدون آنکه تنقیص و یا نگاه نامتعارفی را متوجه آنان سازد.

Reviewing the Opinions of Humiliating People under Protection by Tributary Tax

Regarding the interactions with religious minorities, one of the criticisms of the Islamic jurisprudence that sometimes comes out by some nonMuslims researchers, especially western ones, is that fiqh has been looked down on them and considered them to be devoid of human dignity, so fiqh function toward Ahl alDhimma (people under protection) is humiliating. In support of their claims, they referred to jizya (tributary tax) issue. They claim that based on the analysis and evaluations of Islamic jurists, both Islamic legislation and the way that fiqh addressed the jizya was for humiliating the Ahl alDhimma. Some have said that jizya is the same as blackmail which were taken from defeated nations by the conquerors as coercion and character assassination. This action is also degrading and humiliating. Some others have considered the humiliating of Ahl alDhimma in order to attract them to Islam. This saying has led to other criticism. Having answered to these doubts, this study sought to indicate the rational and logical image of jizya and explain this fact that payment of jizya is just for the services and supports that the Islamic government provides for the Ahl alDhimma without any criticism.
