ماهیت شناسی عزیمت و رخصت در دانش اصول

ماهیت‌شناسیِ انواع حکم شرعی ازجمله مسائل مهم در علم اصول است که درحالِ حاضر مورد توجه ویژۀ اصولیان قرار گرفته‌است. ازجمله مواردی که ذیل ماهیت احکام شرعی مطرح می‌شود، ماهیت‌شناسی عزیمت و رخصت است. دربارۀ ماهیت عزیمت و رخصت بین اندیشوران اصولیِ شیعه و اهل تسنن دیدگاه‌های مختلفی از دیرباز مطرح شده‌است. در نوشتار پیش‌رو پس از مراجعه به منابع مکتوب، به توصیف دیدگاه‌های مطرح دراین‌‌باره پرداخته شده‌است و پس از تحلیل و بررسی دیدگاه‌ها و نقد و بررسی ادله این نتیجه به‌دست آمده‌است که عزیمت و رخصت از احکام تکلیفی ثانویه هستند، بنابراین درمیانِ احکام تکلیفی معروف نگنجیده‌اند.

Exploring the Nature of ʿAzīmah and Rukhṣah in the Principles of ‎Jurisprudence

Exploring the nature of the types of legal precepts (ḥukm alsharʿī) is ‎one of the most important issues in Uṣūl alFiqh (the Principles of Jurisprudence) which is ‎currently of special interest to Uṣūlī scholars. Exploring the nature of ‎ʿazīmah (obligation) and rukhṣah (concession) is one of the issues that is discussed under the ‎nature of legal precepts. A variety of opinions have long been ‎expressed about the nature of ʿazīmah and rukhṣah by Shīʿī and ‎Sunnī Uṣūlī scholars. In the present article, after referring to the written sources, the views expressed in this regard have been described and after analyzing the views and criticizing and examining the arguments, it has been concluded that ʿazīmah and rukhṣah are secondary obligatory rulings. Thus they are included among the famous obligatory precepts.
