مفهوم‌شناسیِ «اصل مثبِت»

مجتهد پس از شک در حکم تکلیفی و نیافتن اماره به‌ناچار برای رفع حیرت در مقام عمل، اقدام به اجرای اصول عملیه می‌کند. موضوعاتی که مجرای اصول عملیه هستند ممکن است همراه خود، لازم، ملازم یا ملزومی چه شرعی و چه غیرشرعی و چه بی‌واسطه یا باواسطه داشته باشند. محدوده و حجیت هر یک از این‌موارد، در اصول‌فقه با عنوان اصل مثبِت موردبررسی قرار می‌گیرد. با درنظرگرفتن ترتیب منطقی، پیش از بحث در مورد حجیت این اصل، ابتدا باید با مفهوم اصل مثبت آشنا شد و همچنین محدوده آن‌را مشخص کرد. با نگاهی اجمالی به تعاریف ارائه‌شده از اصل مثبت از سوی علمای اصول، می‌توان به‌وضوح تفاوت ماهوی هر یک از این تعاریف را با یکدیگر مشاهده کرد. در این پژوهش، با استفاده از روش تحلیلی، به احصا و نقد تعاریف گوناگون از اصل مثبت، پرداخته شده و درنهایت تعریفی جامع ارائه شده است که بتواند دربرگیرنده تمامی‌ عناصر اصل مزبور باشد. اصل مثبت، اصلی است که باهدف رسیدن به حکم شرعی، درصدد اثبات واسطه‌های غیرشرعی یا لازم، ملزوم و یا ملازم شرعی مترتب بر واسطه‌های شرعی و غیرشرعی است؛ بنابراین واسطه‌های شرعی که آثار شرعی به دنبال دارند نیز اصل مثبت خواهند بود.

Conceptology of Muthbit (Establishing) Principle

The Mujtahid (master jurist), after doubting in Ḥukm Taklīfī (defining law) and not finding ʼImārah (indication leading to a speculative reasoning), unavoidably performs practical principles to relieve confusion. Subjects which are the place of performance of practical principles may have with them inherent, implicant and attendant whether they are legal or nonlegal or direct or indirect. In principles of Jurisprudence, the scope and validity of each of these cases is examined under the title of Muthbit Principle. Considering logical order, before discussing on validity this principle, one must first be introduced to the concept of Muthbit Principle and determine its scope as well. With a brief view at the provided definitions for Muthbit Principle by Usuli scholars, it can be clearly seen the essential difference between each of those definitions. Having used the analytical method, this study counted and criticized various definitions of Muthbit Principle. Finally, a comprehensive definition which can include all components of said principle has been provided. Muthbit Principle is a principle that, in order to achieve the legal ruling, seeks to prove inherent or nonlegal intermediates, implicant or legal attendant which is arranged on legal and nonlegal intermediates. So, legal intermediates which follow legal effects will also be a Muthbit Principle.
