چکیده
|
بحث عام و خاص همانند همتای آن مطلق و مقید، یکی از پیچیده ترین مباحث اصولی است و درعین‌حال ثمرات آن در فقه و حقوق غیرقابل‌انکار می‌باشد. متاسفانه پیچیدگی بحث سبب شده که اقوال و مبانی گوناگونی در این زمینه پدید بیاید که بعضاً موجب غفلت بزرگان علم اصول از برخی مسایل بسیار پیش‌پاافتاده و درعین‌حال مهم شود. به‌عنوان نمونه، مشهور اصولیان در بحث مخصّص متصل معتقدند خاص، مانع از انعقاد ظهور در عموم میشود و به عبارت بهتر، عام بعد از تخصیص، مُعنوَن می شود. نگارنده با تکیه بر سیرۀ عُقلا تلاش دارد تا در ابتدا ثابت کند همسنگ‌پنداری وصف با استثناء به الّا در مخصّص متصل نادرست است و ضمن بررسی خصوصیات استثناء به الّا، ثمرات مهم آن ازجمله جواز تمسک به عام در شبهۀ مصداقیه را ثابت کند. البته در ادامه مویداتی ذکر میشود که در کلمات خود اصولیان به تقویت قول جواز تمسک به عام اشاره شده است.

Becoming Muʻanwan of General and its Results in Connected Particularizer

Abstract
|
Although the general (ʻĀm) and the particular (khāṣ) like unrestricted and restricted are one of the most complicated Uṣūlī (principles of jurisprudence) topic, its results are undeniable in Islamic Jurisprudence and law. Unfortunately, the complication of this issue has caused the emergence of various opinions and ideas which sometimes led to negligence of some very obvious yet important issues by the great Usuli Scholars. In the issue of connected particularizer, for example, renowned majority of Usuli Scholars believe that the particular prevents the implementation of appearance in the general, or in better word, the general would become Muanwan after specification. Having relied on the intellectuals’ attitude, the writer at first tried to prove the inaccuracy of alignment of exception by ʼIllā attribute in connected particularizer, then confirm its important results including permissibility of hold on fast to the general in Shubhat alMiṣdāqīyya (doubt in referent) while examining the exception by ʼIllā features. Of course, it is mentioned some confirmations in the statements of Usuli Scholars which indicated the permissibility of hold on fast to to the general.
