بررسی جواز و عدم جواز لمس و دست دادن با زن مسلمان و غیرمسلمان از منظر فقه امامیه

مسئله دست‌دادن مردان و زنان نامحرم از دیر زمان مورد توجه بوده است؛ به‌گونه‌ای که این مسئله مورد سوال اصحاب ائمه: نیز واقع شده است. فقهای عظام نیز به این مسئله پرداخته‌ و دیدگاه‌های مختلفی را دراین‌باره بیان کرده‌اند. در نوشتار حاضر با بررسی و تحلیل منابع مکتوب فقهی و روایی و با استفاده از قواعد و مبانی مختلف اصولی، به تحلیل این فرع فقهی پرداخته شده است. این مسئله از سه جهت احکام اولیه، احکام ثانویه و اصول عملیه مورد مداقّه قرار گرفته و این نتیجه حاصل شده است که دست‌دادن مرد با زن مسلمان جایز نیست، مگر با رعایت سه شرطِ وجود حائل؛ فشار ندادن دست و نداشتن قصد ریبه و لذت. اما نسبت به دست دادن به زنان غیرمسلمان، حکم مسئله بر اساس مبانی و قواعد مختلف اصولی متفاوت می‌شود. بر اساس برخی مبانی و قواعد، دست دادن به ایشان جایز و بر اساس برخی دیگر همانند دست دادن به زن مسلمان حرام است مگر با سه شرط ذکر شده. در نهایت، اگر نسبت به حرمت یا جواز دست دادن به زنان غیرمسلمان شک شود، با توجه به اینکه مسئله از مصادیق شبهه حکمیه تحریمیه است، اصل برائت جاری می گردد و حکم به جواز دست دادن به ایشان می‌شود.

Investigating the (non)Permission of Touching Hands and Shaking Hands with (non)Muslim Women from the Viewpoint of Imamiyah Jurisprudence

The issue of shaking hands with nonmahram men and women has long been noteworthy, as it has been questioned by infallible Imams’ (a.s) companions. Grand jurisprudents have also mentioned this issue and different viewpoints have been mentioned by them in this regards. Having studied and analyzed the written jurisprudential and narrative sources and having used different Osuli principles, the authors of this paper have investigated this secondary jurisprudential issue. This issue has been focused on from three angles of primary rules, secondary rules, and practical principles. It is concluded that a Muslim man’s shaking hands with a Muslim woman is not permissible unless the following three conditions are satisfied: the presence of a veil, not shaking the hands tightly, and shaking the hands with no seductive intention. Nevertheless, regarding shaking hands with nonMuslim women, the rule is issued based on different Osuli principles.
