قاعده اولی حجیت سیره های عقلایی جدید در غیر عبادات

در حجیت سیره عقلایی موجود در زمان معصوم ع و مورد تایید وی اختلافی نیست. لکن در حجیت سیره عقلایی موجود در زمان معصوم ع و ردع نشده از سوی وی نیز تردیدی نیست؛ هر چند گروه اندکی صرف عدم ردع را کافی ندانسته و لزوم تایید را شرط حجیت دانسته اند، ولی درباره سیره عقلایی که در زمان معصوم ع وجود نداشته و پس از وی شکل گرفته، پرسشی درباره حجیت و دلیل بر آن مطرح است. محلّ بحث در نوشتار حاضر مسئله اخیر است. به نظر نگارنده، قاعده اولی در سیره های عام عقلایی جدید در قلمرو غیر عبادات (احکام امضایی) حجیت است و عدم حجیت به دلیل معتبر نیاز دارد. در این مقاله ادله متعددی به سود این دیدگاه فراهم آمده که به نظر نگارنده، بسیاری از آن ها اطمینان بخش است، از این رو، اشکالاتی که درباره آن ها مطرح بوده، به شیوه علمی پاسخ داده شده است. البته درباره برخی ادله مطرح شده، مناقشاتی به نظر م ی رسد که آن ها را هم بیان کرده و آن ادله را غیرقابل اعتماد برشمردیم.

The Primary Rule of the Novel Intellectual Conducts Authority in Nonservitude Issues

Abstract There is no controversy in the authority of intellectual conduct in the periods of the infallible imams as confirmed by them. However, there is no doubt in authority of intellectual conduct in the periods of the infallible imams as not rejected by them as well. Although, there are a number of scholars who believe that nonrejection does not suffice and the necessity of confirmation by the imams is the condition of authority, there is a question on the authority and the reason behind it regarding the intellectual conduct unavailable in the period of the imams which has been formed after them. This paper is to discuss the proposed latter issue. According to the author, the former rule is an authority in general intellectual conducts in the area of nonservitude (signatory) rules, while nonauthority entails a valid reason. Various reasons have been proposed in this paper in favor of this viewpoint which are valid and trustworthy according to the author. Thus, the problems raised about them are resolved scientifically. However, there are some criticisms leveled against some proposed indications that the author has sated them and believes them to be invalid and inauthentic.
