امکان سنجی فقهی اصولی تبعیض در حجیّت خبر

یکی از مسائلی که در مبحث حجیت خبر واحد در کتب اصولی به آن اشاره نشده و به طور مستقل یا ضمنی، گفتار و مبحثی را به خود اختصاص نداده، تفکیک بین فقرات یک روایت از نظر حجیت است، بدین معنا که گاه روایتی وجود دارد که بخشی از آن به دلایل مختلفی از حجیت ساقط و بخش دیگر صحیح و قابل تمسک است. در این نوشتار به طور مشخص در مقام پاسخ به دو سوال هستیم:1.اختلاف بین فقرات یک روایت در حجت بودن یا نبودن، به چند صورت در مباحث اصولی و فقهی ظهور یافته است؟ 2.آیا این تفکیک و تبعیض در حجیت مدلولات یک روایت از نظر علما ممکن و پذیرفتنی است؟ در آرای فقها نظر موافقان تبعیض از نظر تعداد و قوت ادلّه غلبه دارد و در آرای اصولیان هم ضمن مباحثی اصولی و به طور غیر مستقیم پذیرش تبعیض دیده می شود.

The OsuliJurisprudential Feasibility of Hadith Authenticity Sectioning [1]   Mustafa Far' Shirazi [2] Muhammad Taqi Fakhlaee [3] Mansooreh Bokayee [4]   Abstract Sectioning the instances of a tradition regarding its authority is one of the issues which has not been focused on in the subject of solitary hadith in Osuli books. Moreover, this issue has not devoted any discussion to itself in these books explicitly or implicitly. In another sense, there are traditions whose some parts are not authorized due to different reasons while their other parts are trustworthy and valid. Remarkably, this paper is to answer the two questions as follows: How are differences between the parts of a tradition in bearing authority or lacking authority reflected in Osuli and jurisprudential issues?
