امکان سنجی تطبیق روایات ناظر به استهلاک بر مواد افزودنی حرام

امروز به جهت ازدیاد جمعیت و رشد تکنولوژی تولید مواد غذایی از حالت سنتی خارج و به صورت گسترده و صنعتی انجام می گیرد. شرکت های بزرگ مواد غذایی در کنار تولید محصول نهایی به تولید افزودنی های خوراکی به عنوان رنگ ها، چربی ها، نگه دارنده ها و... تحت عنوان (enumber) اقدام می کنند. برخی از این افزودنی ها از حیوانات حرامی چون خوک یا اجزای حیوان غیر تذکیه شده و ... تهیه می شود که امکان استفاده آن طبق فقه اسلامی مجاز نیست. در فقه گزاره هایی وجود دارد که قابلیت آن را دارد به سان یک قاعده در جهت حل بخشی از مشکلات در این زمینه استفاده گردد؛ از جمله این گزاره ها مسئله ای است با نام استهلاک. استهلاک به معنای انعدام عرفی یک افزودنی در شیء ممزوج است به گونه ای که دیگر اسم آن افزودنی بر آن فرآورده صادق نباشد. این مقاله برآن است تا با نشان دادن موارد متعدد استفاده از گزاره استهلاک در فقه آن را در زمره قواعد نوپای فقهی قرار دهد و با استناد فقهی به روایات متعدد آن را استحکام بخشد.

The Feasibility of the Adjusting the Traditions regarding Depreciation

Sayid Mahmud Tabātabāyee [2] Ayoub Karami [3] Muhammad Javād Enāyati Rād [4] Abstract Nowadays, due to the overpopulation and technology development, producing the edibles is carried out in a large scale and is industrialized. However, food is no longer in production using traditional methods. In addition of producing the edibles, huge food companies produce edible additives as colors, fats, preservatives, and so on and so forth under the name of enumber. Some of such additives are taken from unlawful animals like pig or the limbs of a nonslaughtered animal according to shariah laws which are considered unlawful according to Islamic jurisprudence. There are some propositions in jurisprudence which could act as a rule in solving parts of the problem in this respect, such as the depreciation rule. Depreciation means customary extinction of an additive in the mixed object so as to the name of the additive is not used for the product. Showing different cases of using the depreciation proposition in jurisprudence, this paper is to prove that this rule is among newly developed jurisprudential rules and to enrich it based on different traditions with respect to jurisprudence.
