اشعار؛ مفهوم‌شناسی، اقسام و ویژگی ها

این مقاله با پیگیری تعاریف موجود و تحلیل کاربردها و ارتکازات اندیشمندان فقه و اصول، تلاش می‌کند از اصطلاح پرکاربرد «اشعار» ابهام‌ زدایی نماید و پس از تعریف ، تفاوت آن را با ظهور و استظهار بیان نموده و ارتباطش را با هر یک از دلالتهای التزامی‌، سیاقی، مفهومی‌ و مجازی تبیین کند. بنا بر نتایج تحقیق اشعار قسیم ظهور بوده و تقابل آن با مفهوم در بعضی متنها از این روست که مفهوم نیز مصداقی از ظهور است. همچنین اشعار اختصاص به دلالت حقیقی ندارد و در دلالت مجازی و دلالت سیاقی نیز، اشعار وجود دارد. می‌توان اشعار را به «اشعار فعل» و «اشعار قول» و با ملاکی دیگر به «اشعار عاطفی»، «اشعار علّت»، «اشعار حکم تکلیفی»، «اشعار حکم وضعی» و «اشعار فضای صدور» تقسیم نمود. در فرجام ، مقاله با بیان ویژگی‌های اشعار و بیان اصل اولی در هنگام تردید بین ظهور و اشعار یک متن خاتمه می‌یابد.

Ish’ār: Knowing Concept, Classifications, and Features

Providing the available definitions and analyzing the applications and mentalities of jurisprudence and Osūli scholars, the present research attempts to disambiguate the practical term of Ish’ār. Having defining this term, its difference with realization and seeking realization are stated. However, the relation of Ish’ār with other obligatory, stylistic, conceptual, and virtual significations are clarified. According to the findings of the research, Ish’ār is a subcategorization of realization, so that its contradiction to some other texts is due to the fact that the concepts could be as an example of realization. Similarly, Ish’ār does not allocate real signification and virtual and stylistic significations also include Ish’ār. Thus, Ish’ār cloud be classified as Ish’ār of action, Ish’ār of words, affective Ish’ār, Ish’ār of reason, Ish’ār of obligatory rule, Ish’ār of situational rule, and Ish’ār of issuing situation. Eventually, the paper states the features of Ish’ār and is concluded by expressing the primary principle in case of dilemma between realization and Ish’ār in a given text.
