چکیده
|
کارکردهای مقاصد شریعت در فقه امامیه، هدف این مقاله است. اهتمام فقهای امامیه به مقاصد شریعت در مقام استنباط، گاه در توسعه فقه و گاهی نیز در تعمیق آن موثر بوده است. این علم در توسعه فقه با استکشاف حکم، تقیید و توسعه نصوص، جلوگیری از احتیاط‌های شرعی، جلوگیری از حیله‌های شرعی و به عنوان دلیلی در برابر اصول عملیه، و در تعمیق آن با فهم صحیح نصوص، معیاری برای رد یا قبول روایات و نیز درک عقل عملی موثر بوده است.

Abstract
|
The current research is an attempt to make the effect of divine law`s objectiveson developing and deepening Imamiyeh fiqh. As is shown, by the help of divine law`s objectivesImami jurists deduced rules resulting in the development of jurisprudence and deepening of Shariah. In developing jurisprudence, the knowledge gained from Imamiyeh has assisted discovery of rules, development of Nosoos (religious texts), preventing religious cautions and excuses. Therefore as reason, it flies in the face of practical principals and on top of that increases understanding of jurisprudence. In addition, this knowledge has been a standard for accepting or rejecting hadith and validity of religious quotations and a help for logical reasoning.
