ولایت، موضوعی است که فقهای امامیه در طول تاریخ، درباره‌اش تحقیق و تتبع کرده‌اند. در میان ابواب مختلف فقه، مباحثی هست که فقیه را ناچار می‌کند درباره ولایت فقیه بحث و بررسی کند. هدف اصلی در پرداختن به مسئله ولایت، یافتن پاسخ این پرسش است که: اگر مجتهدی جامع‌الشرایط، اداره جامعه را بر عهده گیرد، فقه امامیه برای او چه مرتبه‌ای از ولایت را قائل است و قلمرو ولایت او تا چه محدوده‌ای است؟ تحقیق و تتبع در آثار مکتوب فقیهان به این نتیجه می‌انجامد که اختلاف دیدگاه بین فقیهان و متفاوت‌بودن استدلالشان از نکات بارز این مبحث است. می‌توان گفت اوضاع سیاسی و اجتماعی در دوران‌های مختلف تاریخی نیز در تعیین محدوده اختیارات فقها نقش موثری داشته است. این مقاله دیدگاه انصاری و عبدالکریم حائری، دو تن از فقیهان مشهور، را می‌کاود.

The main purpose of addressing the issue of guardianship is to find the answer to the question: If a qualified jurist takes over the administration of the society, what level of guardianship does Imami jurisprudence consider for him and to what extent is the territory of his guardianship? Research and investigation into the written works of jurists lead to the conclusion that the difference of views and arguments (ع)etween jurists is one of the salient points in this regard. It can (ع)e said that the political and social situation in different historical periods has also played an effective role in determining the authority of jurists. This article explores the views of two prominent jurists Ansari and A(ع)d alKarim Haeri.
