تاثیر کارآمدی نقش پلیس و مدل روابط آن با دادسرا بر افزایش سرمایه اجتماعی نهاد قضایی کشور

فقدان یا کمبودِ سرمایه اجتماعی در ارتباط با نهاد قضایی به معنای بی‌اعتمادی شهروندان به عدالت‌گستری آن دستگاه و در نتیجه عدم مشارکت عمومی با مسئولان و ماموران این نهاد است. افزایش جرایم و تکرار آن‌ها و نقض قوانین نشان‌دهنده کاهش سرمایه اجتماعی نهاد قضایی میان جامعه است. پژوهشگران در پژوهش حاضر درصدد آن بودند که با تحلیل منطقی اسناد و مدارک مرتبط و بر مبنای پژوهش‌های پیشین به بررسی ابعاد مدل کارآمد روابط پلیس و دادسرا از منظر افزایش سرمایه اجتماعی بپردازند و در تحلیل‌های خود به این نتیجه رسیدند که احیای پلیس قضایی به افزایش سرمایه اجتماعی کمک می‌کند. در این نوشتار پیشنهاد می‌شود در فرایند احیای پلیس قضایی به بهبود روابط سازمانی نیروی انتظامی با سازمان دادسرا در قالب ارتباط شبکه‌ای توجه شود. همچنین توصیه می‌شود در سازمان دادسرا و ارتباطی که با پلیس قضایی زیرمجموعه خود دارد سازمان دادسرا با به‌کارگیری ظرفیت‌های مدل ارتباط شبکه‌ای به انعطاف‌بخشی بیشتر در مدل سلسله‌مراتبی بپردازد.

The Effect of the Efficiency of Police Role and the Model of its Relationship with the Prosecution Office on Increasing the Iranian Judiciary Social Capital

The lack of social capital in the judiciary system means the citizens’ distrust of the justice of that institution and, consequently, the lack of public cooperation with its officials and agents. The increase in the number of crimes and their repetition and the violations of laws indicate a decrease in the social capital of the judiciary within a society. The present article seeks to logically analyze the related documents and use the previous research to examine the dimensions of the efficient model of policeprosecution office relations in order to find solutions to increase the judiciary social capital. This article concludes that the restoration of the judicial police helps increase the social capital. We suggest that attention might be paid to the improvement of the law enforcement organization’s relationship with prosecutor’s office in the form of network communication in the process of judicial reform. It is also recommended that the prosecutor’s office employ the capacities of the network communication model in its relationship with its related judicial police and show more flexibility in the hierarchical model.
