چالش انتقال فناوری در قراردادهای بالادستی نفت با تاکید بر قراردادهای بیع متقابل ایران

قراردادهای بیع متقابل یکی از معمول ترین قراردادهای نفتی ایران به ویژه بعد از انقلاب اسلامی است که موافقان و مخالفان متعددی دارد. یکی از اشکالات رایج بیع متقابل، ناظر به ضعف انتقال فناوری از طریق این قراردادهاست. ادعای مخالفان این است که در این نوع قراردادها، به علت ساختار خود قرارداد، دانش فنی به صورت مناسب و کامل به کشور میزبان منتقل نمی شود. در مقابل، موافقان معتقدند که اشکالی به خود قرارداد وارد نیست و می توان در متن قرارداد، بندهایی ناظر به انتقال فناوری و دانش فنی در نظر گرفت و عدم انتقال فناوری منشا دیگری دارد. در این مقاله، ضمن تبیین چالش مورد نظر، به واکاوی ضعف انتقال فناوری در صنعت نفت و میزان اثربخشی قراردادهای نفتی در این زمینه می‌پردازیم. نتایج پژوهش نشان می دهد که علاوه بر فقدان انگیزه کافی در شرکت های دهنده فناوری، مشکلات مربوط به ضعف در ظرفیت جذب برای اکتساب فناوری در داخل کشور نیز از عوامل موثر بر مشکلات انتقال و توسعه فناوری در ایران است. ضمن اینکه با توجه به حضور بازیگران متعدد در بازار فناوری در صنعت نفت، حاکمیت رویکرد سنتی به انتقال و توسعه فناوری از طریق سرمایه گذاری خارجی و قرارداد با شرکت های بین المللی نفتی، زمینه مناسبی برای توسعه فناوری در کشور نیست.

Investigating the Challenges of Technology Transfer in the Iran's Upstream Oil Contracts with Emphasis on Buyback Contracts

Buyback contract is one of the most common Iran's contracts, particularly after the Islamic Revolution, which has many pros and cons.One of the common problems refers to the lack of technology transfer through these contracts. Opponents claim that this type of contract agreements due to their structure, don't have enough ability totransfer technical knowledge and complete transfer to the host country .In contrast, proponents believe that the contract is not wrong to be in the contract, provisions concerning the transfer of technology and knowhow in terms of technology transfer and other sources. This paper has attempted, while explaining this challenge, to explore technology transfer weakness in the oil industry and the effectiveness of their oil contracts in this area. The results show that in addition to the lack of incentives in the technology sender companies, problems related to lack of absorptive capacity for technology acquisition and transmission problems in the country as well as the factors influencing technology development in Iran.While the traditional approaches to the development of technology transfer through foreign investment and contracts with international oil companies, according to the presence of multiple actors in the technology market in the oil industry could be fertile ground for technology development in the country
