شناسایی عوامل موثر بر حقوق مالکیت معنوی در فضای مجازی

به موازات توسعه جوامع و پیشرفت علمی و فرهنگی آن بعضی از مظاهر غیر مادی از جمله حقوق افراد نسبت به مطالبات آنها و جنبه های مختلف بهره برداری از اموال غیرمادی نیز به عنوان نوعی مال شناخته شدند که از آن جمله می توان به حقوق مالکیت معنوی اشاره نمود. از طرفی با پیدایش و گسترش محیط و فضای مجازی، توازن دیرین و همزیستی کپی رایت و منافع عمومی دستخوش آشفتگی شد.همچنین در حال حاضر به خاطر نپیوستن به کنوانسیون برن، ارتباط کشور با سطح بین المللی گسسته است. لذا توجه به حقوق مولف برای ایجاد ارتباط و مبادلات فرهنگی، اقتصادی و ... کشور در عرصه جهانی، ضروری است. در این پژوهش از روش دلفی استفاده شد. جامعه آماری این پژوهش شامل خبرگان، مولفان، مدرسان و فعالان در عرصه، حقوق، ارتباطات و فناوری اطلاعات است که در حوزه مالکیت معنوی نیز تجربه و تخصص لازم را دارا باشند. نمونه مورد مطالعه به صورت نمونه گیری گلوله برفی انتخاب شد. بر اساس نتایج این پژوهش، عوامل موثر بر حقوق مالکیت معنوی در حوزه کتب و نشریات در فضای مجازی در چند محور شناسایی شد در واقع محقق پس از اجرای روش دلفی و اجماع نظر خبرگان، چهار حوزه موثر بر حقوق مالکیت معنوی شناسایی شد که عبارتند از: حوزه رسانه ای، حقوقی، فلسفی و فنی که لزوم سیاست گذاری مطلوب مسائل حقوق مالکیت معنوی، در این چهار حوزه احساس می شود.

Identify the Factors Affecting Intellectual Property Rights in Cyberspace

AbstractAlong with the development of the societies and its scientific and cultural progress, some of the nonmaterial manifestations, including the rights of individuals, to their claims and various aspects of the exploitation of nonproperty were also recognized as a kind of property. These include intellectual property rights. It has also been challenged by the emergence and expansion of cyberspace, longstanding balance and coexistence of copyrights and public interests. At the moment, because of not joining the Bern Convention, the country’s relationship with the international level is disconnected. Therefore, it is necessary to pay attention to the author’s rights to establish cultural, economic and ... relations in the international arena. Delphi method was used in this study. The statistical population of this study includes experts, authors, educators and activists in the field of law, communications, and information technology, which also has the ability and expertise in the field of intellectual property. The sample was selected using snowball sampling. Based on the results of this research, the factors affecting intellectual property rights in the field of books and publications in cyberspace were identified in several fields. In fact, four areas of effective intellectual property rights have been identified: media, legal, philosophical and technical. In the end, the proper policymaking of intellectual property rights issues is felt in these four areas.
