ولایت فقیه در اندیشه آیت الله مهدوی کنی (ره)

مساله ولایت فقیه و فروع آن از دیر باز محل بحث فقها و اندیشمندان شیعی بوده است. امام خمینی (ره) نیز با طرح مجدد این مساله و تکمیل آن توانستند در عمل نیز به تشکیل حکومت اسلامی نائل شوند. در طریق مبارزات انقلاب اسلامی و پس از آن، شاگردان ایشان از جمله آیت‌الله مهدوی کنی نیز به بسط، تبیین و ترویج این نظریه پرداختند. هدف از این پژوهش، تبیین نظریه ولایت فقیه از منظر آیت‌الله مهدوی کنی به روش تحلیل محتوا است. برای این منظور ابعاد مهمی از این نظریه از قبیل مشروعیت حکومت اسلامی، حدود اختیارات ولی فقیه، صفات ولی فقیه و نظارت بر رهبری مورد تحلیل قرار گرفته است. آیت‌الله مهدوی کنی ضرورت تشکیل حکومت اسلامی را امری برخاسته از شرع و مبنای مشروعیت حاکم اسلامی را انتصاب الهی (نظریه انتصاب) می‌دانند و جایگاه مردم در حکومت اسلامی را صرفاً در مرحله فعلیت و تحقق حکومت اسلامی به رسمیت می‌شناسند. ایشان در خصوص اختیارات فقیه، قائل به ولایت مطلقه فقیه بوده و بر همین اساس رابطه ولی فقیه و قانون اساسی را تبیین می‌کنند و در خصوص نحوه نظارت بر رهبری نیز قائل به «نظارت حراستی» هستند.

The issue of velayate faqih and its subordinates from the past were the argument of scholars and shiite scholars’ discussions. Imam khomeini (pbuh) and its restate and completion were able to form an Islamic state in practice. Through the struggle of the Islamic Revolution and then their pupils, including those of Ayatollah Mahdavi, elaborated on, explaining and promoting the theory. The purpose of this study is to explain the theory of velayate faqih, from the viewpoint of Ayatollah Mahdavi, in a method of content analysis. For this purpose, an important aspect of this theory, such as legitimacy of Islamic state, limits of valie faqih, valifaqih traits and supervision over leadership has been analyzed. Ayatollah Mahdavi describes the necessity of forming an Islamic state from sharia and the basis of the Islamic ruling’s legitimacy from divine appointment (appointment theory) and recognizes the position of people in Islamic rule only in the stage of reality and implementation of the Islamic state. In addition, in the case of the rule of the jurist, he is regarding the absolute rule of the jurist, and accordingly to, explaining the relation of the constitution and valie faqih and regarding “protection Supervision” in the case of supervising the leadership.
