راه‌حلی برای چالش مفهوم شناسی عدالت

اندیشمندان حوزه عدالت‌پژوهی تعاریف متکثر و چه‌بسا غیر قابل ‌جمعی از عدالت ارائه داده‌اند. دراین‌میان چگونه می‌توان به حقیقت مفهومی عدالت از میان این تعاریف گسترده دست‌یافت؟ پاره‌ای از این تعاریف «صوری» هستند و بدون ارائه معیارِ تحقق عدالت، قالب شکل‌گیری آن در عرصه‌های مختلف را ترسیم می‌کنند. متقابلاً تعاریف «محتوایی» بر ارائه معیار یا معیارهایی معین برای تحقق عدالت تاکید دارند. نگارنده این تحقیق از طرفی بر این باور است که اولاً تعاریف صوری در تبیین مبادی تصوری حوزه عدالت‌پژوهی بر تعاریف محتوایی تقدم دارند و تعاریف محتوایی در حد «مسائل» عدالت‌پژوهی قرار دارند، نه در مرز «مبادی تصوری» آن. ثانیاً در میان تعاریف صوری مختلف، تعریف عدالت به «اعطای حق به صاحب حق» کامل‌ترین تعریف است و می‌توان با استفاده از نظریه اعتباریات علامه طباطبایی و افزودن دو قید «اعتباری و حکیمانه» به این تعریف، به حقیقت مفهومی عدالت نزدیک‌تر شد. عدالت‌پژوه بر پایه این تعریف، به دنبال حقوق و امتیازاتی است که نظام تکوین به افراد اختصاص نداده است و لازم است با اعتبار آن‌ها که ریشه در واقعیت‌های عینی خارجی دارند حیات اجتماعی مطلوب را ایجاد کرد. این حقوق صدق و کذب نخواهند داشت. بلکه اگر اعتبار آنها ریشه در واقعیات عینی داشت، حکیمانه و در غیر این صورت لغو خواهند بود. بر پایه این تعریف، اهمیت مباحث فلسفی برای دست‌یابی به حقوق اعتباری حکیمانه نیز نمایان گردیده، سر اختلاف عدالت‌پژوهان در تبیین معیارهای عدالت نیز روشن می‌شود.

A Solution to the Semantic Challenge of Justice

The intellectuals on justice research have proposed various definitions of justice though irreconcilable. How may one get the true meaning of justice from among those many definitions? Some of them are formal merely developing a framework for different fields without any criterion for its application on realities. On the contrary, contentbased definitions highlight determined criterion or criteria for the realization of justice.  The author is first of the view that formal definitions take precedence over those of content in term of the explanation of conceptual principles of justice. Contentbased definitions concern issues of justice, rather than the boundaries of its conceptual principles. Secondly, from among those conceptual definitions, giving the right to the rightful is the most complete one. We can get closer to the true meaning of justice if we make use of Allamah Tabatabaii’s theory of mental considerations adding two terms of wisely and mental construct to it. According to this definition, a justice researcher seeks for the rights and advantages that the system of creation has not given to the people, nonetheless, it is necessary to construct them they are rooted in concrete realities outside in the mind in order to create a desired social life. As to those rights, we cannot say that they are true or false. If their consideration is rooted in concrete realities, then it is wise to act upon, or else they are null and void. This definition proves the significance of philosophical discussions for gaining the wisely constructed rights, and also shows the secret of discrepancies of the researchers in their explanation of the criteria of justice.
