چکیده
|
مقاله پیش‌رو با موضوع «تحلیل تربیتی احکام فقهی کودک با محوریت اثبات نسب مبتنی بر متون دینی و یافته‌های علوم جدید و با رویکرد تربیتی، به‌منظور تبیین اهمیت اثبات نسب و تاثیر آن در تربیت کودک» به رشته تحریر درآمده است. در این مقاله، روش توصیفی _ تحلیلی به کار رفته است که با مراجعه به منابع مورد نیاز، فیش‌برداری، گردآوری و تجزیه‌وتحلیل اطلاعات در فضای کتابخانه به مرحله اجرا رسیده است. در مقاله پیش‌رو اقسام نسب و راه‌های اثبات نسب مشروع با تکیه بر قرآن، حدیث، عقل و قانون مدنی از منظر فقه و قانون تبیین شده است. پشتوانه تربیتی، رفع نیازها، حضانت، ولایت بر کودک و تربیت صحیح کودک، از هدف‌های مهم اثبات نسب هستند که در این مقاله مورد بررسی قرار گرفته است. آثار تربیتی اثبات نسب، شامل حرمت ازدواج محارم، رابطه ارث و میراث، خوانده شدن کودک به نام پدر، نفقه و پرورش مطلوب کودک است که با تحلیل تربیتی به آنها دست یافته است.

Abstract
|
The present article has been written on the subject of pedagogical analysis of the jurisprudential rules concerning the child aiming to prove lineage and ancestry based on religious texts and findings of modern sciences. The article has an educational approach and seeks to explain the importance of proving lineage and its effect on educating children. Using a descriptiveanalytical method, the article seeks to record, collect and analyze information in the library setting. The article at hand explains the different types of lineage and the ways of proving legitimate lineage based on the Qur’an, hadith, reason and civil law from the perspective of jurisprudence and law. Educational support, meeting needs, custody, guardianship of the child and proper upbringing of the child are among the important goals of proving ancestry that have been examined in this article. The educational effects of proving lineage include the prohibition of incestuous marriage, the entitlement to inheritance, the child being called after the father, maintenance and the optimal upbringing of the child, which has been achieved through educational analysis.
