روش شناسی فقه تربیتی آیت الله اعرافی دام عزه

با توجه به نظریه پردازی استاد اعرافی دام عزه در دانش فقه تربیتی، در این نوشتار که به روش اسنادی، کتابخانه ای و شیوه توصیفی-تحلیلی انجام پذیرفته، نسبت به واکاوی روش ایشان در استخراج و اصطیاد مبانی و محتوای فقهی با رویکرد تربیتی اقدام گردیده است که یافته های پژوهش آشکار می سازد، ایشان بر اصل تاثیر متقابل تربیت و فقه تاکید نموده و بر این نظر است که هر نوع برخورد و رفتاری دارای آداب و احکامی بوده و در جهت بررسی این موضوع، عرصه های گوناگون تربیت و محتوای آن را بر ابواب فقه عرضه نموده و سپس تاثیرات متقابل در آنها مورد ارزیابی قرار گرفته و به عنوان گزاره های دینی مورد تجویز فقه التربیه قرار گرفته است.ایشان در این مسیر، ابتدا نسبت به گردآوری مباحث تربیتی اقدام و پس از آن به تبویب مباحث مورد نیاز فقه با نظر به رفتارهای جوارحى و جوانحى پرداخته و سپس نسبت احکام پنجگانه با آنها را مورد بررسی و تحلیل قرار داده و در کنار آن به تعیین و تعریف واژه های موضوعات فقهی اقدام نموده است. در وهله بعد ایشان با هدف تعیین محمول و حکم فقهی، با بررسی پیشینه بحث و دیدگاه های موجود به جستجوی ادله خاص قرآنی، روایی و عقلی می پردازند و در بیان ادله، با غور در ادله قرآنی و روایی، با بررسی همه جوانب، به اصطیاد احکام و نظرات تربیتی پرداخته اند. ایشان اصل را در ضابطه مندی علوم تربیتی، بر رعایت شرع و عدم مخالفت با آن قرار داده اند.
