چالش‌های فقهی- حقوقی ناباروری و تاثیر آن بر روابط زوجین

پژوهش حاضر با هدف احصاء چالش‌های فقهی- حقوقی ناباروری و تاثیر آن بر روابط زوجین به‌روش تحلیل مضمون انجام شد. اطلاعات پژوهش بااستفاده از مصاحبه نیمه‌ساخاریافته جمع‌آوری گردید. بدین‌منظور 19 نفر از خبرگان حوزه فقه، حقوق و خانواده که با نمونه‌گیری هدفمند انتخاب و تا رسیدن به اشباع نظری داده‌ها مصاحبه شدند. داده ‌های به‌دست‌آمده بااستفاده از نرم‌افزار مکس‌کیودی‌ای در سه مرحله کدگذری و تحلیل  شد که 37 مقوله از آن استخراج گردید. این مقولات عبارتند از: چالش‌های فقهی (10 مقوله)، چالش‌های حقوقی (9 مقوله)، مهم‌ترین چالش‌های فقهی و حقوقی (8 مقوله)، اثرات منفی ناباروری بر روابط زوجین (4 مقوله) و تاثیر چالش‌های فقهی و حقوقی بر روابط زوجین (6 مقوله). یافته‌ها نشان داد مهم‌ترین مسائل فقهی و حقوقی که خانواده‌های نابارور با آن مواجه‌اند عبارتند از: عدم پایبندی زوجین به تعهدات زناشویی، عدم حمایت کافی قانون در سوء‌معاشرت همسر و اطرافیان، اختلاف نظر فقها در جواز یا حرمت تلقیح مصنوعی، سکوت قانونگذار و نقص قانون درباره روش‌های نوین باروری، بی‌توجهی برخی از افراد به مسائل فقهی. این چالش‌ها سبب سردرگمی زوجین شده و بر روابط ایشان تاثیر دارد.

the jurisprudential-legal challenges of infertility and its effect on couples’ relationships

the current research was conducted with the aim of identifying jurisprudential-legal challenges of infertility and its effect on couples’ relationships by thematic analysis. the data were collected using the semi-structured interviews; thus, 19 experts majored in fiqh, law, and family were selected by the judgmental sampling, and they were interviewed until the saturation stage. the obtained data were encoded through the three phases by maxqda and 37 categories were extracted. these categories included jurisprudential challenges (10 categories), legal challenges (9 categories), the most important jurisprudential-legal challenges (8 categories), negative effects of infertility on couples’ relationships (4 categories), and the effect of jurisprudential-legal challenges on couples’ relationships (6 categories). the results showed that the most important jurisprudential-legal challenges which infertile families face are as follows: couples’ non-adherence to marital commitments, the lack of sufficient legal support in cases of misbehavior between spouses and those around them, jurists’ disagreements regarding the permissibility or sanctity of artificial insemination, the legislator’s silence and the lack of law regarding new methods of fertility, and some people’s inattention to jurisprudential issues. these challenges throw couples into confusion and affect their relationships.
