‌‌بازخوانی حقوق جنسی زوجه از منظر اصول کلان اخلاقی و حقوقی

حقوق خانواده منبعث از ارزش‌های اخلاقی است و ارتباط عمیق قواعد حقوقی و موازین اخلاقی از اصول بنیادین نظام حقوقی اسلام است. ازاین‌رو، توجه به گزاره‌‌های اخلاقی مورد نظر شارع در ساحت خانواده در تدوین احکام، قوانین و قواعد حقوقی ضرورت دارد. پژوهش حاضر باهدف بررسی چگونگی تاثیر اصول کلان اخلاقی و حقوقی در ساحت روابط جنسی زوجین به‌روش توصیفی- اسنادی و با بهره‌گیری از منابع معتبر فقهی و قانونی متقدم و متاخر انجام شد. این پژوهش درصدد پاسخ به این پرسش است که اصول کلان اخلاقی و حقوقی در حیطه روابط جنسی زناشویی و دست‌‌یابی زنان بر حقوق جنسی خود چه کاربردی دارد و آیا این اصول می‌‌تواند در بازتعریف حقوق جنسی زوجه موثر ‌‌باشد؟ اطلاعات بررسی شده بر این نکته دلالت دارد که امر جنسی در اسلام، نظام‌‌مند بوده و به‌صورت جامع توجه و بررسی شده است که در پرتو نحوه تعامل اخلاق‌‌ و حقوق، اصول کلان مشترک به‌عنوان اصول بنیادین و پیشاتشریعی در دست‌‌یابی به حقوق جنسی موثر است. نتایج نشان می‌‌دهد که اصول کلانی همچون عدالت، کرامت، حریم خصوصی و اصل آزادی، گزاره‌‌های مهم مشترکی هستند که می‌تواند روابط جنسی زوجین را از منظر اخلاق مورد بازخوانی قرار داده و حقوق جنسی زوجه را تبیین نماید.

rereading wife’s sexual rights from the viewpoint of general moral-legal principles

the family’s rights is rooted in moral values and the deep relationship between legal rules and moral standards is among the basic principles of islamic legal system; thus, paying attention to jurists’ moral statements in legislating in the matter of the family is necessary. the present study aimed to investigate how the general moral-legal principles have an effect on couples’ sexual relations with a descriptive-documentary method using earlier and later valid jurisprudential-legal sources. the main question is as follows: what is the use of the general moral-legal principles in marital sexual relations and women’s achievement in their sexual rights, and can these principles have an effect on the redefinition of wife’s sexual rights? according to the reviewed information, in islam, a sexual issue is systematic, and it is totally confirmed that, in the light of the interaction between ethics and law, the general shared principles, as basic and pre-legislative ones, have effect on achieving the sexual rights. the results showed that the general principles such as justice, dignity, privacy, and freedom, are the important shared statements that can reread couples’ sexual relations from the view of ethics and explain wife’s sexual rights.
