بررسی تفسیری نشوز زوج و راهکار‌‌های رفع آن با محوریت آیه 128 سوره نساء

نشوز زوج از آسیب‌‌‌‌های مهم نهاد خانواده است که چالش‌‌‌‌های زیادی در روابط زوجین و اعضای خانواده ایجاد می‌‌کند. پژوهش حاضر با هدف بررسی و تحلیل مفهوم، مصادیق و ارائه راهکار‌‌‌های رفع نشوز زوج از دیدگاه قرآن کریم با محوریت آیه 128 سوره نساء به‌شیوه تحلیلی- اسنادی انجام شد. نتایج بررسی‌‌ها در منابع تفسیری و دینی نشان داد که نشوز معانی مختلف و به تبع آن احکام متفاوتی دارد. اگر نشوز مرد به‌معنی کراهت زوج از همسر خود همراه با اراده طلاق و یا به‌معنی رغبتی افسارگسیخته به رابطه جنسی باشد، زن می‌‌تواند برای ایجاد صلح و کسب علاقه شوهرش به ادامه زندگی مشترک، از بخشی از حقوق خود بگذرد. اگر نشوز زوج به‌معنی سرپیچی و مخالفت زوج از ایفای حقوق و الزاماتی که در مقابل زوجه برعهده دارد باشد، زن حق دارد برای گرفتن حق خود همسرش را موعظه نماید و اگر تاثیر نداشت به حاکم رجوع نماید و حاکم زوج را ملزم به ادای حقوق زن نماید و اگر زوج باز هم امتناع کرد، تعزیر می‌‌شود. همچنین ممکن است نشوز به‌معنای رغبت مرد به همبستری و جمع شدن با دیگری باشد که از آن به خیانت تعبیر می‌‌شود که احکام و قوانین خاص خود را دارد.

An Interpretative Study on Husband’s Disobedience and the Solutions for Removing It Based on Verse 128 of Surah Nesa

One of the most important family damages is husband’s disobedience that provides many challenges in couples’ and family members’ relationships. This analytical-documentary research aimed to analyze that concept, its examples, and the solutions for removing it from the view of the Holy Quran, based on verse 128 of Surah Nesa. Reviewing interpretative and religious sources concluded that the disobedience has different meanings and rulings. If husband’s disobedience means that he dislikes his wife along with the will to divorce, or it means a strong desire for sex, his wife can ignore some of her rights in order to absorb his husband’s interest in keeping their common life. If husband’s disobedience means that he disagrees with the rights and requirements for which is responsible, his wife will have the right to advise her husband to respect her rights, and if necessary, she will refer to a ruler so that the ruler obliges her husband to respect her wife’s rights, and if the husband still refuses, he will be punished. Moreover, the disobedience may mean husband’s desire for sex with others that it is called cheating, which has its own rulings.
