واکاوی حق معاشرت‌به‌معروف در روابط زوجین با تاکید بر حقوق فطری

امروزه مقررات و احکام اسلامی به‌ویژه در حوزه خانواده با شبهات و اشکالاتی روبه‌روست که یکی از بهترین راه‌های حل این شبهات و اشکالات مراجعه به حقوق فطری و تطبیق مقرارات اسلام با این حقوق است. پژوهش حاضر با هدف واکاوی حق معاشرت‌به‌معروف در روابط زوجین و برای پاسخ به این سوال که حق معاشرت‌به‌معروف تا چه‌میزان با حقوق فطری زوجین، مبانی فطری ایشان و خانواده منطبق است، انجام شد. بدین‌منظور کلیه آثار علمی مربوطه به‌شیوه توصیفی- اسنادی مورد بررسی قرار گرفت. با بررسی‌های انجام شده، مطالعه‌ای که به‌طور مستقل موضوع پژوهش حاضر در آن بررسی شده‌باشد، یافت نشد. نتایج نشان داد که تکلیف معاشرت‌به‌معروف بیشتر متوجه فردی است که دارای اختیارات است و در انجام این اختیارات امکان سوءاستفاده‌ وجود دارد. رفتار شایسته هریک از زوجین، موافق با فطرت و طبیعت ایشان و همگام با اصلی‌ترین هدف و کارکرد خانواده یعنی، ایجاد مودت و رحمت است. معاشرت‌به‌معروف نباید برخلاف ویژگی‌های زوجین و نظام خانواده باشد که براین‌اساس، در خانواده، مصلحت نوعی و شخصی باید همزمان مورد توجه قرار گرفته و تامین شود.

Exploring the Right to Good Behavior in Couples' Relationships with the Emphasis on Inherent Rights

Nowadays, there are some doubts and problems in the Islamic rules, particularly in family, that referring to inherent rights and adapting the Islamic rules to them is one of the best ways to solve these problems. The purpose of this research is to explore the right to good behavior in couples’ relationships and to answer the question of how much the right to good behavior is compatible with couples’ inherent rights, their inherent foundations, and family; thus, all related scientific sources were descriptively-documentarily reviewed, and there was no study that examined the subject of this research. The results showed that a person having authorities and there is the possibility of their misuse has more right to good behavior. The good behavior of each of the couples is in accordance with their natures and is compatible with the creation of kindness and mercy as the main purpose and function of family. If the good behavior is against couples’ characteristics and the family system, both the typical and personal expediency should be taken into account simultaneously.
