بررسی تطبیقی مقاصد نظام خانواده در آراء اندیشمندان دانش مقاصد‌الشریعه

رویکرد نظری مقاصد‌الشریعه ازجمله نگرش‌های موجود در فلسفه فقه و حقوق اسلامی است که با تکیه بر اندیشه غایت‌مداری احکام شریعت، سازوکار روش‌مداری را در پردازش نظام‌مند احکام شرع ارائه می‌دهد. پژوهش حاضر با هدف بررسی تطبیقی اندیشه علمای این دانش نظری، به‌شیوه توصیفی- اسنادی انجام شد و ضمن ارائه گزارشی از غایات و مقاصد شریعت در حوزه خانواده، تحولات آن را نیز بررسی نمود. بدین منظور کلیه آثار علمی مکتوب در توصیف و تطبیق آراء متفکران برجسته متقدم و متاخر مقاصدی درباره مقاصد نظام خانواده مورد بررسی قرار گرفت. نتایج نشان داد که بیشتر تحولات اندیشه‌های این متفکران در پنج‌محور طبقه‌بندی می‌شود که عبارتند از: توسعه اندیشه مقاصدی از مقوله محدود نکاح به موضوع وسیع نظام خانواده؛ تاکید بر حمایت و پشتیبانی مقاصد ذاتی خانواده از مقاصد کلان شریعت؛ عنایت فزاینده به انتظام‌بخشی احکام متفرق خانواده ذیل نظام مقاصد مربوط به آن؛ عبور از چهارچوب نظری صِرف و تلاش برای فعال‌سازی، به کارگیری و تطبیق مقاصد خانواده بر احکام ناظر به آن؛ توجه به مسئولیت اجتماعی خانواده و انضمام مقاصد اجتماعی به اهداف این نهاد.

A Comparative Study on the Family System from the Perspective of Scholars of the Knowledge of Maghased al-Sharia

The theoretical approach to Maghased al-Sharia is one of the current attitudes in the field of the philosophy of jurisprudence and Islamic law that presents a methodical mechanism in the systematic processing of Sharia rules based on the goal-oriented thought of Sharia. This descriptive-documentary research aimed to comparatively study the thoughts of scholars of this knowledge, present a report on the goals of Sharia in the field of family, and review its changes; thus, all written scientific sources about descripting and adapting the ideas of prominent early and late goal-oriented scholars on the goals of family system were reviewed. According to the results, most of the changes of these scholars’ perspectives are categorized into five groups, including: the development of goal-oriented thought from the limited topic of marriage to the vast issue of family system, the emphasis on the support of intrinsic purposes of family for the general purposes of Sharia, a more attention to regulating various family rules under the system of related goals, the avoidance of theorizing and an attempt to practice, the use and adaption of the family purposes to its rules and the focus on the social responsibility of family and adding social purposes to aims of this system.
