رابطه مبانی ضرورت رشد عقلی و مسئولیت پذیری کودکان و نوجوانان در پرتو منابع اسلامی و تحول الگوی اسلامی- ایرانی

بلوغ عقلی که معیار رشد عقلی است، درک اوامر و نواهی دین را برای مسئولیت پذیری کودکان و نوجوانان زیر 18 سال مورد توجه قرار می دهد. پژوهش حاضر با هدف تعیین بهترین ملاک ایجاد مسئولیت در افراد زیر 18 سال صورت گرفت که برای دستیابی به این ملاک ها، مبانی شرعی ضرورت احراز رشد عقلی و فکری این افراد تحلیل شد و دیدگاه های فقهی موافق و مخالف کفایت بلوغ جنسی مورد بررسی قررا گرفت. این پژوهش که با روش توصیفی-تحلیلی و به صورت مطالعات کتابخانه ای انجام گرفت، نشان داد که الگوی اسلامی ایرانی بر خلاف پذیرش احراز رشد عقلی در تحقق مسئولیت بر اساس مقررات جدید، همچنان سن بلوغ شرعی را که در زبان فقهی به مفهوم رسیدن به مرحله ای از رشد جنسی است، مبنای هر نوع مسئولیت تلقی نموده است. این موضوع سبب شده است که دختران در سنی تکلیف پیدا کنند که از توانایی ذهنی لازم برای انتساب مسئولیت بی بهره اند. براین اساس، با توجه به عدم تطابق سن بلوغ شرعی با واقعیات عینی و اجتماعی، و عدم تفکیک بلوغ عبادی از بلوغ غیرعبادی در این سن، با پیش بینی سن خاصی برای سن تمییز در الگوی اسلامی ایرانی همانند سایر نظام های اسلامی، افزایش سن بلوغ غیر عبادی دختران با توجه به وجود زمینه های فقهی این تغییر ضروری به نظر می رسد.

The Relationship between the Fundamentals of the Need for Intellectual Growth and Responsibility of Children and Adolescents in the Light of Islamic Resources and Change Based on the Islamic-Iranian Pattern

The intellectual maturity, which shows the intellectual growth, considers the understanding of orders and prohibitions of religion for creating a sense of responsibility of the children and adolescents under the age of 18. In the present study conducted with the aim of identifying the best criterion for creating a sense of responsibility of individuals under the age of 18, the jurisprudential foundations of necessity of having the intellectual growth among these individuals were analyzed and the jurisprudential pros and cons of sufficiency of sexual maturity were reviewed. This descriptiveanalytical study which applied the library method showed that in spite of new regulations that accept to create a sense of responsibility based on having the intellectual growth, the IslamicIranian pattern considers the age of jurisprudential maturity, which means to get to the stage of sexual growth in the jurisprudence, as a basis for each kind of responsibility. It causes that the age at which girls become duty bound is to the extent that they do not have enough mental ability to assign responsibility; thus, at that age, due to the mismatch between the jurisprudential maturity and obvious and social realities, and the nonseparation of maturity in worship and maturity in nonworship, because the jurisprudential fields are provided it is necessary to increase the girls’ age of maturity in nonworship by predicting a special age as a differentiation age in the IslamicIranian pattern like other Islamic systems.
