چکیده
|
پژوهش حاضر با هدف بررسی راهکارهای پیشگیرانه فقهی- حقوقی سقط جنین در راستای رسیدن به هدف افزایش جمعیت به شیوه تحلیلی- توصیفی انجام شد. بنابراین، این موضوع که چه ضمانت اجرایی برای پیشگیری از جرم سقط جنین وجود دارد که با مبانی و اصول معتبر حقوقی و شرایط زمان و مکان هماهنگی و تطابق دارد، بررسی گردید. در پژوهش حاضر، ضمن بررسی حالات مختلف سقط جنین این مطلب که عدم اجرای قانون، ابهام قانون و وجود خلاهای قانونی سه نقصی است که در سیستم حقوقی و قضایی در این خصوص وجود دارد نیز بررسی شد. از جمله راهکارهای پیشگیرانه که می تواند به کاهش آمار سقط جنین و رسیدن به سیاست افزایش جمعیت منجر شود، پیشگیری کیفری است که در قالب وضع مجازات متناسب در مورد مرتکب سقط جنین می تواند قابل اعمال باشد. از این رو، رفع ابهام از ماده 306 قانون مجازات اسلامی که سبب فهم مختلف درباره تعزیر مادر که مباشر و یا معاون سقط جنین است و همچنین سبب نسخ مجازات موضوع مواد 622 الی 624 شده است، مفید و لازم به نظر می رسد.

Abstract
|
The purpose of this descriptiveanalytical study is to investigate the preventive jurisprudentiallegal solutions of abortion to achieve a policy of increasing the population; thus, the main question is: what executive guarantee is there to prevent the abortion that it is in consistence with valid legal principles and timeplace conditions? In present study, in addition to discussing the different kinds of abortion, the lack of law enforcement, the ambiguity of law, and the legal gaps were discussed as three defects which are in the legaljudicial system. One of the preventive solutions, which can decrease the rate of abortion and lead to achieve a policy of increasing the population, is criminal prevention which could be applicable in the form of legislating the appropriate penalties against who gets the abortion. Therefore, it is useful and important to eliminate the ambiguity of Article 306 of the Islamic Penal Code which causes to misunderstand the discretion (Tazir) of mother (as an offender or a crime partner) and causes to breach the penalty of Articles 622624.
