اهمیّت حقوق خانواده در ادبیات سنّتی فارسی با رویکرد به حقوق زوجین

اندیشه رعایت حقوق زن و مرد از باورداشت های مردمان ایرا ن زمین از دیرباز بوده است که این اندیشه ها را در قالب نظم و نثر برای آیندگان به میراث گذاشته اند. پژوهش حاضر با هدف بررسی حقوق زوجین در ادبیات سنتی فارسی به روش توصیفی- تحلیلی انجام شد. با بررسی های تطبیقی قوانین حقوقی- فقهی زوجین در کتب حقوقی معاصر و آثار نظم و نثر فارسی )از قرن چهارم هجری تا قرن معاصر( این فرضیه که سخنوران فارسی زبان به دلیل اشرافی که بر مبادی حقوق بشری مندرج در فقه و حقوق اسلامی داشته اند، این مبادی و مظاهر آن را در کلام خویش منعکس می کردند، اثبات شد. یافته های این پژوهش نشان داد که سخنوران فارسی زبان، به حقوق زن در جایگاه همسر، حقوق مرد در جایگاه شوهر و حقوق مشترک آن دو، هماز نظر مادی و هم از نظر اخلاقی و روحی - روانی به طور شایسته ای توجه داشته و آن را در آثار خود نمایان می کردند که این امر تلاشی از سوی ایشان برای تحکیم بنیان خانواده بوده است؛ موضوعی که امروزه شاید کمتر مورد توجه است.

The Importance of Family’s Rights in Persian Traditional Literature with an Approach to Couples’ Rights

From a long time ago, the thought of respecting women’s and men’s rights has been one of the beliefs of the Iranian people who have inherited these thoughts in the form of poetry and prose for future generations. The present research was conducted with the purpose of investigating couples’ rights in Persian traditional literature by a descriptiveanalytical method. A comparative study on the legaljurisprudential laws in the contemporary legal books and Persian poetry and prose works (from the fourth century AH to the contemporary century) confirmed the hypothesis that Persianspeaking speakers due to their knowledge on the principles of human rights, cited in Islamic jurisprudence and law, reflected these principles and their manifestations in their words. The findings showed that Persianspeaking speakers properly took into consideration women’s rights as wives, men’s rights as husbands, and their common rights, both materially and morallymentally, and reflected them in their works that it demonstrated their attempts for strengthening the foundation of family; perhaps, today, this is an issue to which less people pay attention.
