درآمدی بر سیاستگذاری عمومی در جمهوری اسلامی با رویکرد فقهی

این مقاله به بررسی نقش آموزه‌های دینی و فقهی در سیاستگذاری عمومی جمهوری اسلامی ایران می‌پردازد. به‌عنوان نظامی که مدعی تحقق اهداف شریعت است، سیاستگذاری در جمهوری اسلامی باید بر پایه‌ اصول دینی و مقاصد شریعت استوار باشد. عدم توجه به این موضوع ممکن است به برداشت‌های نادرست یا اقتباس ناکارآمد از مدل‌های سکولار بینجامد که ریشه‌هایی متفاوت با اهداف نظام دینی دارند. پرسش اصلی این پژوهش چگونگی تبیین و تنظیم سیاستگذاری عمومی در چارچوب ارزش‌های دینی است؟ یافته‌ها نشان می‌دهند که آموزه‌های فقهی، قواعد فقهی و مقاصد شریعت می توانند به‌عنوان چارچوب اصلی در تصمیم‌گیری‌ها مورد استفاده قرار گیرند. این رویکرد می‌تواند به تحقق اهداف نظام اسلامی کمک کند.

an introduction to public policy in the islamic republic with a jurisprudential approach

this article examines the role of religious teachings and jurisprudence in public policy in the islamic republic of iran. as a system claiming to fulfill the objectives of sharia, policy in the islamic republic must be grounded in religious principles and the aims of sharia. neglecting this issue may lead to misinterpretations or the ineffective adoption of secular models, which have fundamentally different roots from the goals of a religious system. the main question of this research is how public policy can be properly defined and aligned with religious values within this framework. the findings indicate that jurisprudential teachings, jurisprudential principles, and the objectives of sharia should serve as the primary framework for decision-making. this approach can contribute to achieving the goals of the islamic system.
