چکیده
|
این نوشتار در نقد مقالة «حکم نفقة زن بیوه بر اساس آیة 240 سورة بقره» نوشتة آقای امیر مهاجر میلانی و بیان نظر صحیح در نفقة بیوه به قلم آمده است. گرچه مقالة آقای میلانی دارای تتبع و نوآوری و دقت مناسبی است؛ اما برخی ایرادهای محتوایی و شکلی و ویرایشی نیز دارد. ایرادهای محتوایی به دو بخش ایرادهای کلی و موردی تقسیم شده است. در بخش ایرادات محتوایی کلی، سه ایرادِ «نبود تتبّع جامع»، «ذکر نشدن پاره‌ای از مباحث لازم» و «نداشتن ثبات نسبی در نقاط مختلفی از مقاله» ذکر شده است؛ همان‌گونه که در بیست مورد، اشتباهات مولف و نواقص مقاله‌اش به عنوان ایراد محتوایی موردی مطرح شده است. سپس عنوان مقاله نقد شده و به پاره‌ای ایرادهای شکلی و ویرایشی نیز اشاره شده است. درنهایت و بر خلاف نظر مولف، نتیجه این شده که طبق روایات و نظر مشهور، آیة 240 سورة بقره در حکم عده نسخ شده و درعین‌حال، حکم استحباب وصیت برای زوجه پابرجاست.

A Critique of the Article The Verdict of Alimony for Widows based on Verse 240 of Surah Al-Baqarah

Abstract
|
This study is a critique of the article &The Ruling on Alimony for Widows based on Verse 240 of Surah AlBaqarah& written by Mr. Amir Mohajer Milani in order to explain the correct view on alimony for widows. Mr. Milani’s article is wellresearched, innovative, and accurate; however, it has some problems in its content, form and edition. Content defects are divided into general and case problems. In the section on general content problems, three problems are mentioned: &lack of comprehensive compliance&, ¬ mentioning some of the necessary discussions& and &lack of relative stability in different parts of the article&. As in twenty cases, the author’s mistakes and the shortcomings of his article are presented as a casebycase content problem. Then, the title of the article is critiqued and some formal and editing flaws are mentioned. Finally, contrary to the author’s opinion, it has been concluded that according to popular narrations and opinions, verse 240 of Surah AlBaqarah has been abrogated as edde ruling, and at the same time, the ruling of accepting a will for a wife is still valid.
