معنای فقهی تمتع در روایات باب نکاح

روایات امامیه در مسئله عقد موقت با دختر باکره رشیده، مضمون واحدی ندارند؛ گاهی ازدواج موقت با دختر باکره منع شده و گاه با شرایطی خاص تجویز شده است. در روایات جواز عقد موقت با باکره، گاهی در سوال راوی و گاه در بیان امام معصوم،(ع) واژه «تمتع» با عناوینی همچون «التَّمَتُّعِ مِنَ الْاَبْکارِ» و «التَّمَتُّعِ بِالْاَبْکارِ» به کار رفته است. بسیاری از فقها به پشتوانه ارتکاز فقهی، واژه تمتع در این روایات را به معنای اصطلاحی آن، یعنی نکاح موقت با دختر باکره معنا کرده و جواز چنین ازدواجی را نتیجه گرفته‌اند؛ اما  آیت‌الله شبیری زنجانی این واژه را بر معنای لغوی آن حمل کرده و این روایات را بیانگر جواز استمتاعات جنسی از دختر باکره در فاصله بین عقد دائم و عروسی دانسته است. طبق معنای اخیر، این روایات هیچ ارتباطی با مسئله جواز عقد موقت با باکره نخواهند داشت. با توجه به نبود دلیل محکم در سخنان فقها بر مدعایشان و نقد و بررسی نشدن دیدگاه اخیر، در این پژوهش سعی شده ضمن نقد این دیدگاه، با استناد به کثرت استعمال و اثبات انصراف، تحلیل متن روایات و بررسی قراین تاریخی، از دیدگاه مشهور دفاع و مفهوم «التَّمَتُّعِ بِالْاَبْکارِ» تبیین شود.

The Jurisprudential Meaning of Gratification in Narrations on the Issue of Marriage

Imamiyeh’s narrations do not have an allied content on the issue of temporary marriage contract with an adolescent virgin maid; in some cases temporary marriage with an adolescent virgin maid is forbidden, whereas in other cases it is authorized with special conditions. In the narrations on the issue of the authorization of temporary marriage contract with an adolescent virgin maid sometimes in the question of the narrator and sometimes in the expression of infallible Imams the term gratification was used with titles such as AlTamato ’min alAbkar _gratification from virginity _and AlTamato’ belAbkar. Many jurists, with the support of jurisprudential mutual consent, interpreted the term gratification in these narrations according to its idiomatic meaning, that is, temporary marriage with a virgin maid, therefore, came to the conclusion that such a marriage is authorized. However, Ayatollah Shobeyiri Zanjani interpreted this term based on its literal meaning and considered these narrations as expressing the permission of sexual gratification from a virgin girl in the interval between a permanent engagement and wedding. According to the latter meaning, these narrations are not related to the issue of permitting temporary marriage contract with a virgin maid. Due to the lack of strong reason in the interpretations of the jurists on their claims as well as the absence of criticism and review of the recent view, while criticizing this view, the study aims to defend the popular common view and explain the concept of AlTamato’ belAbkar by referring to the frequency of its use and proving the omission; analyzing the text of the narrations and examining historical evidence.
