تاثیر اندیشه های حقوقی بر شکل‌گیری قانون اساسی در حقوق اسلام و غرب با تاکید بر اندیشه شهید بهشتی

قانون اساسی به عنوان سند مهم سیاسی و حقوقی هر جامعه، متضمن تعیین مبنای حاکمیت و صلاحیت زمامداران و نیز تبیین حقوق اساسی ملت است. اندیشه­های حقوقی در شکل‌گیری چنین سند مهمی نقش به سزایی دارند. در این نوشتار تلاش شده است تا با رویکردی تطبیقی اثر اندیشه­های حقوقی بر شکل‌گیری قوانین اساسی در حقوق اسلام و غرب مورد مطالعه قرار گیرد. بر این اساس در ابتدا به واکاوی موضوع در سنت اروپایی و غربی مبادرت شده است. در این سنت آرای اشخاصی نظیر ارسطو، منتسکیو، ژان ژاک روسو و جان لاک بررسی شده‌اند. سپس اندیشه­های سنت اسلامی منعکس در آثار فقهایی نظیر علامه نایینی، شیخ فضل‌الله نوری و شهید صدر پیرامون نظام حقوق اساسی تحلیل شده است. در نهایت به ارزیابی اندیشه­ها و آرای شهید بهشتی و تاثیر آن بر تدوین قانون اساسی جمهوری اسلامی ایران پرداخته­ایم. فرض اساسی مقاله بر مبنای تاثر مستقیم شکل‌گیری و اصلاح قوانین اساسی از اندیشه های حکومت‌داری می‌باشد.

The Effect of Legal Thoughts on the Formation of Constitution in Islamic and Western Law with an Emphasis on the Shahid Beheshti Thought

Constitution is the most important document in the legal and political communities. In this article, the basis of jurisdiction and authorities and their fundamental rights will be elaborated. Legal theories played a great role in the formation of such an important document. The authors studied comparatively  on influences of legal thoughts in Islam and the West on the formation of constitutions. So we analysis the Western European tradition: the ideas of  Aristotle, Montesquieu, Jean Jacques Rousseau and John Locke…then  the opinions of Muslim thinkers like, Abu Nasr Farabi, Allama Naini, Sheikh Fazlullah Nuri, alSadr has been analyzed. Finally, the influence of  Shahid Beheshti ideas and opinions on the constitution of the Islamic Republic of Iran has been explained. The basic assumption of this article is based on the belief that the formation and modification of the basic rules of governance are directly influenced by government and state Theories.
