هدایتگری و مداخله‌گری دولت بر معادن در نظام حقوقی ایران با نگاهی بر نظریات فقهی و تطبیق آن با کشور مکزیک

هدایتگری‌ها و مداخلات در معادن، توسط دولت از دوران گذشته تاکنون همواره تاثیر بارز و شایانی در بخش معادن داشته است. دیدگاه قانون‌گذار در اعطای صلاحیت هدایتگری و مداخله‌گری، ریشه در نظرات فقهی پیرامون مالکیت معادن دارد که بعضاً این نظریات با یکدیگر در تضاد است و انعکاس این تضادها در قوانین معدنی از سال‌های گذشته تا به امروز کاملاً واضح است. لذا در این مقاله، ابتدا نظرات فقهی پیرامون معادن در فقه شیعه بیان و در ادامه به واکاوی قوانین که مبین حدود و ابزارهای هدایتگری و مداخلات دولت است، پرداخته خواهد شد. متعاقب آن به‌دلیل وجود معادن معتنابه و نفت‌خیز بودن و تشابه نظام حقوقی (رومی‌ژرمنی یا حقوق نوشته) با کشورمان به بررسی معادن در کشور مکزیک می‌پردازیم. لازم به ذکر است منابع علم حقوق نیز در کشور مکزیک، همانند کشورمان شامل قانون اساسی، قوانین عادی، آرای قضایی، عرف و دکترین است. در انتها، با رد نظریه انفال و اثبات احاطه حقوق عمومی بر معادن، بیان می‌شود که دولت با سیاست‌گذاری، ازجمله با کمک نهاده‌ای هدایتگر به هدایتگری، با بهره‌برداری مستقیم از برخی معادن به مداخله‌گری می‌پردازد و با بررسی معادن در کشور مکزیک، به مشابهت بسیار زیاد مقررات معدنی کشورمان با کشور مکزیک پی خواهیم برد.

guidance and interventions in mines by the government from the past until now have always had a significant impact on the mining sector. the viewpoint of the legislator in granting guidance and intervention authority is rooted in jurisprudential opinions about the ownership of mines, which sometimes conflict with each other, and the reflection of these conflicts in mining laws from the past years to the present is quite clear. therefore, in this article, firstly, the jurisprudential opinions about mines in shia jurisprudence will be expressed, and then the analysis of the laws that show the limits and tools of the government’s guidance and interventions will be discussed. legal (roman-germanic or written law) with our country, we are investigating mines in mexico. it should be noted that the sources of legal science in mexico, like our country, include the constitution, ordinary laws, judicial opinions, custom and doctrine. in the end, by rejecting the theory of “anfal” and encircling public rights on mines, it is stated that the government intervenes with policies, including with the help of guiding institutions, with the direct exploitation of some mines, and with the inspection of mines in mexico we will find out the mining regulations of our country with the country of mexico.
