مطالعه تطبیقی اصل تناسب مجازات در جرایم مواد مخدر و مولفه‌‌های موثر در اعمال آن در حقوق ایران و غرب

اصل تناسب مجازات به عنوان یکی از اصول بنیادین حقوق کیفری، متضمن تعیین مجازاتهایی است که با ضرر اجتماعی ناشی از جرم همخوانی داشته باشد. در این میان، اعمال این اصل در جرایم مواد مخدر و در مرحله تقنین، با توجه به اهمیت این جرایم و پیچیدگی آنها، نیازمند دقت نظر و ظرافت طبع قانونگذار است. بدین ترتیب که با لحاظ مولفه‌‌های موثر در اعمال اصل تناسب از بی‌عدالتی در تعیین و اجرای کیفر کاسته و به تبع اهداف مورد انتظار از مجازات همچون بازدارندگی را دستیافتی‌تر نماید. رفتار مرتکب و نوع جرم ارتکابی، نقش متهم و نحوه مداخله وی در جرم و نیز شدت و وخامت جرم ارتکابی از مهمترین مولفه‌‌هایی هستند که در اعمال اصل تناسب مجازات در این جرایم موثرند. حال آنکه قانونگذار در قانون مبارزه با مواد مخدر صرفاً بر تناسب میان کمیت مواد با میزان مجازات تاکید داشته و سایر مولفه‌‌ها را نادیده گرفته است.
