چکیده
|
بحث عسر و حرج در نکاح که به زوجه اختیار طلاق می‌دهد از مباحث مهم در زندگی خصوصی خانواده‌ها و راه خلاصی است برای رهایی زوجه از زندگی پرمشقتی که با زوج دارد. از آن جایی که این مساله مبتلا به خانواده‌های ایرانی و غیرایرانی مثل فرانسه است در این مقاله به بررسی مصادیق تحقق عسر و حرج در نکاح در قانون ایران و فرانسه پرداخته‌ایم. بدیهی است که در این زمینه برخی مشترکات و برخی تفاوت‌ها در مصادیق تحقق عسر و حرج وجود دارد. از موارد مشترک در مصادیق عسر و حرج می‌توان از ترک زندگی مشترک به مدت قابل توجه، ابتلای زوج به بیماری‌های صعب العلاج، سوءمعاشرت زوج و محکومیت قطعی زوج به زندان نام برد. در مورد مصادیق غیر مشترک می‌توان به عدم پرداخت نفقه، عقیم بودن زوج، ازدواج مجدد زوج، اشتغال زوج به شغل مغایر با مصالح خانوادگی و استفاده مستمر از داروهای روان گردان در حقوق ایران و نیز ارتکاب زنا از ناحیه احد زوجین، طول کشیدن مفارقت جسمانی به مدت 6 سال، تحقیر و توهین احد زوجین یا مفقودالاثر شدن یکی از آنها در قانون فرانسه اشاره نمود.

Abstract
|
the question of Hhardship in a marriage that gives the power of divorce to a wife is one of the important issues in the private lives of families and a way to get rid of a wife from a difficult life she has with the husband. Since this is a problem with Iranian and nonIranian families such as French ones, this article has dealt with the implications of the examples of marriage in the law of Iran and France. It is clear that in this area there are some similarities and some differences in the examples of the realization of hardship. Similar examples of hardship may include the abandonment of common life for a significant period of time, suffering from refractory diseases by the husband, misbehavior of the husband, and a decisive conviction the husband to be imprisoned. Different examples are nonpayment of the family cost, infertility of the husband, remarriage of the husband, man’s employment in jobs contrary to the interests of the family, and the continued use of psychotropic drugs in Iranian law, and committing adultery by one of the couples and lying for 6 years in physical separation, degradation and insulting by one of the couples or missing of one of them in French law.
