the criterion of crimes against humanity and the reasons for its prohibition in comparative jurisprudence

Authors rabiee ali akbar ,naghibi abolghasem
Abstract    the novelty of the term crime against humanity in international law raises the question of what its nature and criteria are in jurisprudence، and what evidence exists to demonstrate that crimes against humanity are prohibited in comparative jurisprudence. to answer this question، the concept of humanity must be explored within jurisprudential anthropology so that a crime against it can be conceived. the present study، by collecting library resources from islamic denominations of jurisprudence and employing a descriptive-analytical method، seeks to address a question that holds both fundamental and practical significance in the international arena. it is deduced from the sources of jurisprudence that the nature of a crime against humanity is anything that conflicts with the purposes of human creation، namely، being the vicegerent of god (khalīfat allāh). the criterion of a crime against humanity in the jurisprudence of islamic denominations is the existence of a widespread، numerous، and deliberate attack on the essential purposes of the sharia (maqāṣid al-sharī'ah)—namely، religion، life، intellect، honor، lineage، and property. as a result، the value and dignity of humanity are assaulted، and obstacles are created in achieving the goals of human creation. the proofs for the prohibition of crimes against humanity in comparative jurisprudence include qur'anic verses، hadiths، analogical reasoning (qiyās)، custom ('urf)، and the rational method (sīrat al-'uqalā')، all of which indicate its prohibition and the legitimacy of punishing the perpetrators.
