   سوگند قضایی غیرمسلمان در فقه امامیه و اهل‌سنت

چکیده    براساس شرع اسلام، سوگند به خداوند متعال، یکی از راههای اثبات یا اسقاط دعواست. یکی از مسائل مطرح و مورد بحث در باب سوگند قضایی، سوگند شخص غیرمسلمان است، که در ادای سوگند توسط غیرمسلمان، چگونگی و تغلیظ آن، دیدگاههای مختلفی ابراز گردیده است. پژوهش حاضر به روش کیفی به بررسی مبانی قرآنی و روایی سوگند قضایی غیرمسلمان، در فقه امامیه و اهل ‌سنت پرداخته است. در فقه امامیه و اهل ‌سنت، طبق قول مشهور سوگند قضایی اهل ‌کتاب و غیر اهل ‌کتاب مطلقاً پذیرفته شده است، لکن با بررسی ادله قرآنی و روایی، باید قائل به تفصیل شده و سوگند اثباتی و اسقاطی اهل ‌کتاب، سوگند اسقاطی غیرکتابی (در مقام مدعی ‌علیه)، سوگند اثباتی غیرکتابی معتقد به خداوند (مدعی) را پذیرفت. لکن سوگند اثباتی غیرکتابی منکر خداوند را نباید پذیرفت. هم‌ چنین براساس نظر مشهور فقیهان امامیه و اتفاق ‌نظر فقهای اهل ‌سنت، سوگند کفار (اهل ‌کتاب و غیراهل ‌کتاب) تنها باید به خداوند متعال یا اسماء خاصه او باشد و در نهایت جمهور فقهای امامیه و مشهور فقهای اهل ‌سنت، تغلیظ سوگند کافر را واجب نمی ‌دانند.

   NonMuslim Judicial Swearing in Imami and Sunni Jurisprudence

Abstract    According to Islamic law, swearing to God Almighty, is one of the ways to prove or abstain a claim. One of the issues raised and discussed in relation to the oath of office is the oath of the nonMuslim person, expressed in terms of swearing by nonMuslims, and the way it should be done. The present study investigated the Qur’anic principles and the validity of nonMuslim judicial sworn judgments in Imami and Sunni jurisprudence. In Imami and Sunni jurisprudence, according to the common narration, the oath of office of nonMuslims is absolutely accepted. However, by examining the Qur’anic and narrative arguments, it is necessary to take this issue into account in a more detailed way. Therefore, swearing of Ahl alKitab (People of the Book), swearing of NonMuslims other than Ahl alKitab for defending themselves (as the accused), and swearing of NonMuslims other than Ahl alKitab who believe in God (as the claimant) are accepted. However, swearing of NonMuslims other than Ahl alKitab, who do not believe in God, as the claimant must not be accepted. Also, according to the majority of Imami jurisprudents and the consensus of Sunni jurisprudents, the oath of the infidels (Ahl alKitab or other than Ahl alKitab) must only be taken to Allah the Almighty or His specific names. And finally, most of Imami jurisprudents and majority of Sunni jurisprudents believe that infidels are not obliged to confirm the sacred oath.
