چکیده    قانون مدنی شرایط مال موضوع عقد رهن را در مواد گوناگون بیان کرده ولی متعرض رهن مال مشاع نشده است. از این سکوت، می‌توان این ‌گونه استنباط کرد که از آنجا که رهن مال مشاع، منع نشده، علی‌الاصول صحیح است. با این حال، این مسئله در فقه مورد اختلاف است، جدا از فقه حنفی که رهن مال مشاع بدون اخذ رضایت سایر شرکا را صحیح نمی‌داند، در میان سایر مذاهب فقهی نیز درباره لزوم یا عدم لزوم اخذ اذن شرکای راهن در مرحله قبض اختلاف نظر وجود دارد. در میان این اختلا‌فها، نظر فقهای شیعه بر لزوم اخذ اذن شرکا در مرحله قبض است. این عقیده در نظام حقوقی کنونی نیز قابل تایید است. توضیح آنکه سهم شرکا در مال مشاع در عالم واقع از سهم همدیگر قابل تمییز و تفکیک نیست، اما در عالم اعتبار این‌گونه نبوده و سهم شرکا از یکدیگر جدا بوده و از استقلال برخوردار است. برای همین، تصرفات اعتباری هر یک از شرکا به اندازه سهم خویش خللی به حقوق سایرین وارد نکرده و معتبر خواهد بود؛ چرا که تصرف، تنها در محدوده سهم شخص اتفاق می‌افتد اما تصرفات مادی، این‌گونه نیست: تصرف در هر جزء از مال، ملازمه با تصرف در سهم دیگران دارد و بنابراین اذن سایر شرکا نیز باید اخذ شود. اگر قبض بدون این اذن واقع شود نه تنها سبب مسئولیت مدنی قابض می ‌شود، بلکه در اعتبار قبض نیز می‌باید تردید کرد. در ضمن، اگر شریک از دادن اذن امتناع کند، به نظر می ‌رسد بر خلاف آن چه در فقه گفته شده است، امکان الزام وی از طریق حاکم وجود نداشته باشد و او حق دارد تا برای قبض اذن بدهد یا ندهد. بنابراین، نمی ‌توان اجبارش کرد. در نتیجه، به نظر می ‌رسد تنها راه، درخواست تقسیم مال مشاع باشد. هم چنین، در صورتی که با وجود دادن اذن از سوی شریک، در خصوص شخص قابض اختلاف حاصل شود، می ‌توان به حاکم رجوع کرد.

   Mortgage of a Shared Property

Abstract    The civil code has expressed the conditions of a property which can be the subject of mortgage but the possibility of the mortgage of a shared property has not been mentioned. Regarding the silence of the civil code about the issue, it can be inferred that a shared property can be the subject of mortgage. However, this issue is the subject of conflict among experts. Hanafi jurisprudents believe that mortgage of a shared property is impossible without the consent of other share holders but jurisprudents from other jurisprudential schools have different ideas about the necessity of asking for permission of other share holders in preempt situation. Among these different ideas, the idea of Shi‘a jurisprudents is that it is necessary to ask the other share holders for permission in preempt situation. This idea is generally accepted in the present legal system as well. The reason is that although in reality, the shares of each share holder cannot be separated, but theoretically they are separable and independent. Therefore, mortgage on a joint property is possible but in preempt situation it is not possible without the consent of other owners, since it interferes with their rights. So, parties’ agreement on mortgage of a joint property is correct while in preempt situation it needs other owners consent or otherwise it would be subject to liability and the accuracy of such contract is under question too. Moreover, and on the contrary with what it has been said in Fiqh, it seems that it would not be right to make other owners give their consent. Therefore, the only solution is to divide the property. Also, if there is no agreement about the person who is going to deliver the property, the court would be the right person for it.
